Comments:
A renewal inspection was conducted on March 16, 2023 between the hours of 8:30am and 1:00pm. There were 42 children present, with 8 staff supervising within the supervision guidelines. The inspector reviewed compliance in the areas of administration, physical plant, staffing and supervision, programming, children and staff records, medication, special care and emergencies and nutrition. Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.

Violations:
Standard #: 22.1-289.035-A
Description: Based on record review, the provider did not obtain documentation for a 5 year repeat check.
Evidence:
1. Staff #3's record did not have documentation of a 5 year criminal history repeat check.
2. The last documentation of a criminal history check expired on 3/10/2022.

Plan of Correction: I will get these submitted today.

Standard #: 22.1-289.035-B-4
Description: Based on record review, the child day center did not obtain a copy of the results of an out-of-state sex offender registry check and a search of the child abuse and neglect registry by the end of the 30th day of employment.
Evidence: Staff #5 (DOH 10/17/22) did not have documentation of out-of-state sex offender registry check nor an out-of-state child abuse and neglect registry search.

Plan of Correction: I will submit this search today.

Standard #: 8VAC20-780-160-A
Description: Based on record review, staff record did not contain documentation of a negative tuberculosis test or screening at the time of employment.
Evidence: Staff #1 date of hire is 9/9/22 and at the time of inspection (3/16/22) there is no documentation of a TB test/screening on file.

Plan of Correction: I will have my staff bring the TB screening to me by Monday.

Standard #: 8VAC20-780-160-C
Description: Based on record review, 1 of 5 staff records did not contain documentation of a current TB test or screening, conducted every two years from the date of the first initial screening or test. Evidence: Staff #3 (DOH 09/1989) most recent documented TB test was dated 10/14/2010. (expired: 10/14/2012).

Plan of Correction: I will have my staff bring in the TB screening by Monday.

Standard #: 8VAC20-780-270-A
Description: Based on observation, the center did not ensure the areas and equipment of the center, inside and outside, shall be maintained in a clean, safe and operable condition. Unsafe conditions shall include, but not be limited to, splintered, cracked or otherwise deteriorating wood; chipped or peeling paint; visible cracks, bending or warping, rusting or breakage of any equipment; head entrapment hazards; and protruding nails, bolts or other components that could entangle clothing or snag skin.
Evidence: There was chipped and peeling paint above the sink in the children's restroom.

Plan of Correction: I will put in a work order and have the wall repaired by next week.

Standard #: 8VAC20-780-510-G
Description: Based on observation and interview, medication was not labeled with the child's name, the name of the medication, the dosage amount and the time or times to be given.
Evidence: 1. A bottle of Hyland's Cough & Mucus syrup was in a plastic bag with dispensers and not label with a child's name.
2. Staff #2 stated the Hyland's Cough & Mucus syrup belong to Child #4.
3. An epi-pen for Child #1 was in a clear plastic baggie, and not labeled with the name of the medication, the dosage and the time or times.
4. The provider acknowledge the epi-pen for Child #1 was not labeled.

Plan of Correction: I will send the medication home tonight and have the parents return tomorrow with the label.

Standard #: 8VAC20-780-520-C
Description: Based on record review and interview, the center failed to obtain written parent authorization noting any known adverse reaction shall be obtained.
Evidence:
1. Child #1 did not have parent authorization on file for Eucerin ointment.
2. Child #5 did not have parent authorization on file for Aquaphor ointment
2. Child #6 did not have parent authorization on file for Aquaphor ointment
3. Child #7 did not have parent authorization on file for Aquaphor ointment
4. The provider acknowledged there were not written parent authorizations for Child #1, #5, #6, and #7.

Plan of Correction: I will send the diaper cream home today with the over-the-counter authorization form and will tell the parent we must have the written authorization with the diaper ointment or cream.
