Comments:
An unannounced inspection was conducted on March 6, 2023 from 11:45 a.m. to 1:40 p.m. This inspection was initiated from a self-report that was received on March 2, 2023 regarding staffing and supervision. There were 87 children present, ranging in ages from five months to five years, with 12 staff supervising. The inspector reviewed center video recordings, incident documentation, two children and three staff records, as well as interviewing three staff.

Violations:
Standard #: 8VAC20-770-60-C-2
Description: Based on review of three staff records, the center failed to obtain a Virginia Central Registry check for one staff within 30 days of employment.

Evidence:

1. The record for Staff #2 did not have documentation of obtaining a Virginia Central Registry check within 30 days of employment. Staff #2?s date of hire was documented as 10/11/2022.
2. Staff #4 confirmed documentation of a Virginia Central Registry check was not completed for Staff #2.

Plan of Correction: 1. Administrative Staff went through each staff file identifying any missing
documents or trainings.
2. All missing components are to be completed by 3/31/2023 or the staff members will be suspended until complete.

Standard #: 8VAC20-780-40-E
Description: REPEAT VIOLATION

Based on interview, review of documentation and of video recording, the licensee failed to ensure that the center?s activities, services and facilities are maintained in compliance with the policies and procedures that are required by these standards.

Evidence:

1. Based on the review of the video recording taken by the center?s video cameras, on March 2, 2023, Staff #1 and Staff #2 lined the children up to leave the multipurpose room. At approximately 11:24:28 a.m., Staff #1 and Staff #2 exited the classroom with 11 children, leaving Child #1 and Child #2, both 2 years of age, unsupervised in the multipurpose room.
2. Child #1 and Child #2 were observed out of sight and sound supervision of staff from approximately 11:24:28 a.m. through 11:28:55 a.m.
3. The center?s current supervision of children policy states, ?No staff are EVER allowed to leave a child who is 12 and under in a classroom or playground by themselves.?
4. The center?s Name to Face policy states, ?To prevent the loss of accountability of any children, all staff are required to do a name to face (utilizing the Procare Connect App) whenever crossing over any threshold or when transferring over responsibility of the children to a fellow co-worker.?
5. Staff #4 confirmed Staff #1 and Staff #2 did not follow the center?s Supervision of Children policy and procedures.

Plan of Correction: 1. Self reported the incident to CPS and DSS and provided evidence and documentation.
2. Terminated Staff #2 for failure to execute the organizations policies and procedures.
3. Placed Staff #1 on a Performance Improvement Plan.
4. Held a mandatory emergency staff meeting 3/8/22 to review all supervision policies and guidelines with all staff.
5. Emailed a memo to all staff that contained all of our policies regarding supervision and accountability. And required a signature from reach staff
member acknowledging their receipt, understanding, and compliance of the policies and procedures.

Standard #: 8VAC20-780-340-F
Description: REPEAT VIOLATION

Based on review of video recording and staff interview, the center failed to ensure two children, under the age of 10, were within actual sight and sound supervision of staff.

Evidence:

1. Based on the review of the video recording taken by the center?s video cameras, on March 2, 2022 at approximately 11:20 a.m., 13 two-year old children were playing in the multipurpose room under the supervision of Staff #1 and Staff #2. Per timestamps on the video recording, at approximately 11:21:56 a.m. Child #1 and Child #2, both age 2, crawled across the floor to hide behind a white board. At approximately 11:24:28 a.m., Staff #1 and Staff #2 exited the classroom with only 11 children. At approximately 11:28:55 a.m., Staff #3 entered the multipurpose room and found Child #1 and Child #2 hiding behind the white board.
2. Child #1 and Child #2 were out of direct sight and sound supervision of staff for approximately 4 minutes.
3. Interview with Staff #1 confirmed Child #1 and Child #2 were out of sight and sound supervision of staff.

Plan of Correction: 1. The center created a new policy to require that one teacher line up children during
a transition and the other sweep the room for any hidden children.
2. All teachers in the classrooms must conduct name to face simultaneously. The staff member conducting a name to face with an ipad will state the
child's name. The staff member without the ipad and the staff member with an ipad will both verbally acknowledge or point to a child to
acknowledge their presence and that they are in line to transition to the next
destination.
3. The white board was removed from the gross motor room and will be placed on the playground instead.
