Standard #: 8VAC20-780-40-E
Description: Based on observation and record review the center did not ensure the operational responsibilities of the licensee to include ensuring that the center's activities, services, and facilities are maintained in compliance with these standards, the center's own policies and procedures.

Evidence
1. Staff #1 did not follow the center's policies and procedures when she used physical punishment, pulling and restricting the movement of a child in care. As a result Child #1 sustained a friction burn on the face.

2. The center' s "Positive Guidance and Redirection," Policy and Procedures states, "No staff member is permitted to use physical, mental or emotional punishment on any child ?in anyway." The policy further states the act of pulling and restricting a child's movement is not permitted.

Plan of Correction: Management will retrain all staff on Naptime Procedures and Positive Guidance and Redirection though ongoing meetings and in person trainings that review policy, but also go over various scenarios and appropriate responses and actions. Management will perform frequent check-ins with classroom staff to ensure compliance and offer necessary support.

Description: Based on interviews, record review and video footage, the center did not ensure forbidden actions where not used with children.

Evidence:
On 03/09/2023 at approximately 11:40am, Staff #1 used her hands to force a 2 year-old child to lay on her cot. As a result, the child sustained a friction burn to the face that matched the mesh pattern of the cot.Video footage verified the following:

1. Staff #1 roughly picked-up Child #1 who was not napping and carried her to her cot. Staff #1 abruptly flipped the 2 year-old's body over to her stomach and repeated this action at least three times following the child attempting to turn herself over.
2. On two occasions when Child #1 moved her body to the top of the cot, Staff #1 jerked Child #1's leg, causing her body to slide down the cot.
