Technical Assistance:
Inspector and director discussed supervision and training opportunities. Discussed the potential enforcement actions as a result of most inspection.

Comments:
An in-person investigation was conducted on March 8, 2023 from 1:20pm until 2:40pm in response to a self-reported incident regarding supervision and the care and protection of children. Interviews were conducted and video-camera footage was reviewed.? A total of 2 child records and 1 staff record were reviewed. Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.

Violations:
Standard #: 8VAC20-780-340-A
Description: Based on video footage and interview, the staff supervising children did not always ensure their care, protection and guidance.

1) On March 2, 2023, Staff 1 was supervising 2 children in the school age classroom.
2) While in the home living area, Child 1 (6 years old) and Child 2 (9 years old) crouched behind and adjusted the play mirror to stay out of view.
3) The video footages shows that over the span of approximately 15 minutes, Child 1 pulls shirt up exposing torso, and Child 2 touches Child 1?s buttocks over their clothes.
4) Child 1 stated that they showed Child 2 their private area and that Child 2 touched Child 1?s buttocks.

Plan of Correction: These are the immediate actions that were taken to prevent reoccurrences; The staff member will be closely monitored and not be scheduled to work alone until the probationary period ends (6 months). This staff member has received coaching and training from the director and seasoned staff on properly positioning oneself in a classroom, how to keep children engaged in activities, and how to help children solve various situations when the arise. The staff member is also required to complete 15 trainings totaling approximately 27 hours that include topics on child abuse & neglect, supervision, curriculum, keeping children safe and development for various age groups.

Description: Based on video footage and interview, Children under 10 years of age were not always within actual site and sound supervision of staff.

1) On March 2, 2023, Staff 1 was supervising Child 1 (6 years old) and Child 2 (9 years old) in the school age classroom.
2) In the video footage, Child 1 and 2 can be seen playing in the home-living area. The two children repeatedly adjust the play mirror, making small adjustments each time to hide from view.
3) For approximately 15 minutes, Staff 1 is sitting at a table about 20 feet away and did not check on the children hiding behind the play mirror.
4) Staff 1 stated they thought Child 2 was hiding from their parent during pick up time and was not aware of what the children had been doing until the following day March 3, 2023, when supervisors discussed the incident.
