Comments:
An investigation was initiated on March 27, 2023 with another local agency after an allegation was reported by the Center on March 23, 2023. The center reported a 23 month old sustained an arm injury while on the playground. Interviews were conducted, files were reviewed, observations were made, classrooms observed, and ratios were checked.

Violations:
Standard #: 8VAC20-780-340-A
Description: Based on interview and observation, it was determined staff on March 22, 2023, did not ensure the care and protection of a child.
Evidence:
1. On March 22, interviews confirmed Staff #3 tried to guide child #1, a 23 month old, to the smaller playground by lifting the child up by one arm, twice.
2. During interviews of staff, Staff #2 stated child #1 was crying on and off while playing in the playground and then inside the class.
3. Staff #1 stated child #1 was not able to lift up the arm, and the decision was made to contact the family.
4. Child #1 was taken to the Doctor, diagnosed with a dislocated arm, and the arm was placed back in.

Plan of Correction: We self reported and terminated the staff member. Staff did not realize lifting the child could cause this and we terminated the staff member. We also sent a memo to all staff reminding them that lifting a child by the arm is never permitted.

Standard #: 8VAC20-780-410-1
Description: Based on observation and interviews, it was determined staff #2 roughly handled a 23 months old child on the playground.
Evidence:
1. On March 22, 2023, staff #3 acknowledged that child #1 was lifted by the arm twice. Staff #3 stated child #1 was not going to the playground so it was staff #3's way to direct the child to the playground.
2. Video of the occurrence was captured by the center's cameras and played for review. The video shows the teacher lift child #1 by the arm and put the child down. Staff #3 lifted the child again and placed down again. Each occurrence was clocked and each lift was two seconds in length.
3. The lifting of child #1 by the arm resulted in dislocation of child #1's arm.

Plan of Correction: We reported the incident and terminated the employee. The employee stated several times that lifting was not meant to hurt but we explained zero tolerance. We also immediately set up a reminder for all staff to read and sign stating lifting children by the arm is never permitted.
