Comments:
An unannounced investigation was initiated on 01/12/2023 and concluded on 03/31/2023 regarding a self reported incident. Interviews were conducted and program policies and training was reviewed. After interviewing involved parties, violations were issued and can be viewed on the Violation Notice.

Violations:
Standard #: 8VAC20-780-40-E
Description: Based on interview and a review of the center?s policies and procedures, the licensee did not ensure that the center?s activities, services, and facilities are maintained in compliance with these standards, the center?s own policies and procedures that are required by these standards, and the terms issued by the department.

Evidence:
1. The center?s allergy policy states ?Every KU center may have children and / or staff members with a variety of allergies. As a result, the following procedures are to be in place regarding allergy awareness and response: It is the responsibility of every staff member to monitor the center-wide allergy list and be aware of response requirements?.
2. Staff #1 confirmed that on 1/11/2023 at approximately 5:10 pm, Child #1 (age 2-years) was served approximately 4 crackers for snack, exposing Child #1 to an allergen. Staff #1 did not verify Child #1?s allergens listed on the center allergy list before serving Child #1 crackers. Child #1 suffered a severe allergic reaction.

Plan of Correction: We have mandatory staff meetings to remind staff the importance to review child allergies and action plans in each classroom.

At enrollment we will continue to make sure to confirm with parents the type of allergy and get clarification if there are any questions regarding action plan.

Center administration is in constant contact with regional leadership if support is needed. There are weekly check in meetings where VDOE Health and Safety Standards are reviewed as a pillar of quality so that compliance with licensing standards are maintained.

Center administration reports to licensing as needed and reaches out the inspector for assistance.

Standard #: 8VAC20-780-340-A
Description: Based on interview, when supervising children, staff did not always ensure care, protection and guidance.
Evidence:
1. Staff #1 confirmed that on 1/11/2023, Child #1 (age 2-years) was served 4 butter crackers at snack time, exposing the child to an allergen.
Staff #1 did not verify Child #1?s allergens listed on the center allergy list before serving Child #1 crackers.
2. After being picked up from care, Child #1 suffered an allergic reaction and had to be administered Benadryl and then taken to the emergency room for an epinephrine injection.

Plan of Correction: We have mandatory staff meetings to remind staff the importance to review child allergies and action plans in each classroom.

Standard #: 8VAC20-780-560-P
Description: Based on interview, a child diagnosed with a food allergy was served a food identified on their written allergy are plan.

Evidence :
Staff #1 stated that on 1/11/2023, Child #1 (age 2-years) was served approximately 4 butter crackers for snack. Child #1 has a diagnosed food allergy and the center was provided with an allergy action plan. Child #1 had a serve allergic reaction to the crackers that were served.

Plan of Correction: We have mandatory staff meetings to remind staff the importance to review child allergies and action plans in each classroom.
