63.2 Child Abuse & Neglect

Comments:
The licensing inspector conducted an unannounced complaint inspection on 03/29/2023 In response to a complaint that was received in the licensing regarding allegations in the area of Transportation. Interviews were conducted with staff, records reviewed and observations of the program were made relating to the allegation. Information gathered during the inspection determined non-compliance(s) with applicable standards or law and violations were documented on the violation notice issued to the program.

Violations:
Standard #: 8VAC20-780-180-C
Complaint related: Yes
Description: Based on a record review and interview the center did not ensure staff who drive a vehicle transporting children disclose any moving traffic violation that occurred five years prior to or during employment or assignment as a driver.

Evidence:
The center's van driver, Staff #1, did not have documentation of disclosing a driving record. The program director confirmed Staff #1 has not disclosed a driving record to the center.

Plan of Correction: Documentation has been put in the driver?s file on site. The director will ensure all required documentation is available on site.

Complaint related: Yes
Description: Based on observation the center did not ensure the vehicle used to transport children met the safety standards set by the Department of Motor Vehicles and was kept in satisfactory condition to assure the safety of children.

Evidence:
The blue van used to transport children did not meet all requirements.
1. The vehicle had an expired inspection sticker on the license plate dated December 2022.
2. The back bumper of the vehicle was hanging off of the car on the rear drivers side
3. The tire on the front passenger side had very low tread.
4. The headline inside the vehicle was hanging from the roof.

Plan of Correction: 1. Replacement decals for the plates were ordered from DMV.
2. The decorative plastic piece on the vans rear bumper was secured back to the bumper.
3. A new tire will be put on the van.
4. The fabric on the interior top of the van will be secured.
The director will ensure the van remains within standards set by DMV.

Standard #: 8VAC20-780-580-C
Complaint related: Yes
Description: Based on a record review and interview the center did not ensure emergency numbers as specified in 8VAC20-780-550 I and K where maintained during transportation.


Evidence:
1. The center did not have the following required information kept on the 2 vehicles used to transport children: local emergency contact information, potential shelters, hospitals, evacuation routes, etc., that pertain to each site frequently visited or of routes frequently driven by center staff for center business such as field trips or pick up or drop off of children to or from schools etc.

2. The program director confirmed that the center does not have any maps of routes or other local emergency information kept on the center vehicles or in the emergency binder taken during transportation.

Plan of Correction: Required documents will be added to the vans emergency binders. The director will ensure all required documents will be in the vans emergency binders for
transportation.
