An unannounced complaint inspection was conducted on April 6, 2023, from 9:50 a.m. to 11:45 p.m. The complaint was received on March 24, 2023, regarding programs, staffing and supervision. Eight staff members were interviewed. Two staff records were reviewed.
Information gathered during the inspection supports at least one of the allegations and the complaint was determined to be valid. Two complaint related violations and one non-complaint violation were documented on the violation notice issued to the program.

Standard #: 8VAC20-780-400-B Complaint related: No Description: Based on documentation, the center failed to ensure that behavioral guidance is constructive in nature, age and stage appropriate, and intended to redirect children to appropriate behavior.
Evidence:
1. The document ?Significant Event Summary? completed by Staff #3 on 12/30/2022 indicated that on 12/29/2022, Staff #4 reported seeing Staff #5 ?hit (Child #1?s) hands after (Child #1) had hit children and scratched (Staff #5)?.
2. A written statement by Staff #5 dated 12/29/22, stated ?I was sitting with (Child #1) when she started pinching me and hitting a friend and I gently tapped her hand.?
3. A written statement by Staff #4, dated 12/29/2022, indicated that Staff #5 ?was holding (Child #1) in her lap when (Child #1) went to smack another child. (Staff #5) smacked (Child #1?s) hands about 3 times then took (Child #1) out of her lap and put her on the ground kinda hard. (Staff #5) then pushed (Child #1) away stating (Child #1) could no longer have attention because she hit someone.?
4. A written statement by Staff #6, dated 1/10/2023, stated ?(Staff #5) smacked (Child #2?s) hand after pushing it away several times did not work? and ?(Child #3) was trying to get in her highchair and was standing on it so (Staff #5) smacks her hand after telling her to get down several times?.
5. A written statement by Staff #2, dated 1/9/23 stated that Staff #2 had noticed Staff #5 being rougher with the babies by ?yelling at them?. Staff #2 stated ?(Staff #5) has also kinda slammed them down when she has been frustrated?.Plan of Correction: Employee was placed on administrative leave on 12/29/22, immediately when management learned of this. After an internal investigation, employee was terminated.
