Comments:
An unannounced monitoring inspection was conducted on 4/12/2023 from 10:35 am to 1:08 pm. There were five children in care, ages three years to seven years, in one group under the care of one staff. The Licensing Inspector reviewed four children?s records, three staff records, and other program records. The children were observed playing inside, outside, and eating lunch.

Information gathered during the inspection determined non-compliance(s) with applicable standards or law and violations were documented on the violation notice issued to the program.

Violations:
Standard #: 22.1-289.035-A
Description: REPEAT VIOLATION

Based on record review, the provider failed to have required repeat background checks completed every five years.

EVIDENCE:
The most recent national fingerprint (criminal) check for Staff 2 was dated 8/22/2017.

Plan of Correction: Backgrounds have been completed.

Description: Based on document review, the center?s written playground safety procedures did not have all the requirements.

EVIDENCE:
The centers written playground safety procedures, ?New Beginnings Learning Center Playground Safety, updated January 1, 2023? did not address the method to maintain resilient surfacing.

Plan of Correction: Add procedures to maintain resilient

Standard #: 8VAC20-780-270-A
Description: REPEAT VIOLATION

Based on observation, the center was not maintained in clean, safe, or operable condition.

EVIDENCE:
1. The white plastic rocking toy was cracked at the rear, near the bottom causing a pinch point. Previously cited during the inspection conducted 11/3/2022. The toy was accessible to children.

2. The green ladder was cracked on both sides of the second step causing a pinch point was cited during the inspection conducted on 11/3/2022. The ladder was accessible to children.

3. There was broken glass in the area between two slides.

4. In the blue-gray classroom, panels of wallpaper are peeling off the bottom section of the wall. Children were eating lunch in this room. The peeling area was approximately five feet wide and five feet high.

5. The edge of the large round table, accessible to children, has the top edge cracking off, about 1 to 2 inches away from the side edges, creating numerous pinch points.

Plan of Correction: Toys will be removed.

Panels have been fixed.

Table plans to be replaced.

Description: Based on observation, the center failed to have resilient surfacing and to have fall zones around climbing equipment in accordance with the National Program for Playground Safety?s ?Selecting Playground Surface Materials: Selecting the Best Surface Material for our Playground,? February 2004.

EVIDENCE:
There are two slides on the playground and there is no measurable amount of resilient surfacing at the base of either of them. The slides are connected to plastic climbing structures and there is no use zone or fall zone around either structure.

Plan of Correction: Put down resilient surface down, and fall zones.

Description: Based on observation and interview, the center failed to have on the premises one staff member qualified as a program leader and an immediately available staff member.

EVIDENCE:
From the start of the inspection at approximately 10:35 am through approximately 11:55 am, there was only one staff person on the premises. There were five children in care during this time.

Plan of Correction: Two staffs to be on premises

Standard #: 8VAC20-780-530-C
Description: Based on observation, the center failed to have at least two staff members with current certification in first aid (FA) and cardiopulmonary resuscitation (CPR) whenever children are in care.

EVIDENCE:
From approximately 10:35 am to approximately 11:55 am, Staff 2 was the only staff person present with current certification in First Aid/CPR. There were five children in care during this time.
