Comments:
An unannounced inspection was initiated on 04/27/2023 and concluded on 05/02/2023 in response to a complaint that was received by the department on 4/18/2023 regarding allegations in the areas of behavior guidance and supervision. The inspection was initiated on site on 4/27/2023. The inspector was on site from approximately 8:36 am-11:53 am. Interviews with staff were completed, observations were made in the center, and documentation was reviewed. Additional interviews were conducted remotely.

The preponderance of the evidence gathered during the investigation supports part of the allegation; therefore, the complaint is determined to be valid. See the violation notice for more details. You will need to specify how the deficient practice will be or has been corrected. Just writing the word corrected is not acceptable. Your plan of correction must contain: 1) steps to correct the noncompliance with the standard(s), 2) measures to prevent the noncompliance from occurring again; and 3) person(s) responsible for implementing each step and/or monitoring any preventative measures. Complaint related: Yes
Description: Based on interview, the center did not ensure that behavior guidance was constructive in nature, age and stage appropriate, and intended to redirect children to appropriate behavior and resolve conflicts.

Evidence:
1. On 4/17/2023, it was reported that staff #1 was speaking to an administrator about an incident that had occurred between themselves and child #1?s parent earlier that morning. Child #1?s parent had reportedly requested that her child be separated from specific other children due to a conflict that had occurred on 4/10/2023 and staff #1 was upset about the confrontation. Child #1 reported that she said she knew that staff #1 was speaking about her parent and that staff #1 said, ?Go tell your mom, I don?t care.? In an interview, staff #1 confirmed that when she heard child #1 state that she was talking about her mom, she did say, ?You can go tell her that, I don?t care.? Staff #1 acknowledged that the statement was inappropriate and not constructive and stated she was ?overwhelmed.?
2. Administration acknowledged that the statement that staff #1 made to the child was not appropriate.
