Comments:
An unannounced focused monitoring inspection was conducted on March 27, 2023. The inspection is a follow-up to an Intensive Plan of Correction. There were 51 children ages five through eight years old in care with three staff at the onset of the inspection. The site director arrived after the inspection was underway. Children were observed in teacher and self-directed activities inside and outside the facility. Violations were observed, cited on the violation notice and discussed with the site director during the exit interview, in the areas of : Administration and Staffing and Supervision.

Violations:
Standard #: 8VAC20-780-140-A
Description: Based on record review and interview the center failed to ensure each child has physical examination as required.
Evidence:
1 ? The record for Child #1 does not contain a hard copy or digital copy of any physical examination.
a. Child #1 has a documented date of enrollment as September 6, 2022.
2 ? Staff #1 confirmed that the center did not have the required physical report in hard copy or digital form.

Description: Based on observation and interview the center failed to ensure that emergency contact for each staff is kept at the center.
Evidence:
1 ? There is no emergency contact information at the center for Staff #1.
2 ? Staff #1 stated that he was aware that his emergency card was not present at the center.
a. Staff #1 further stated that he began overseeing this location two weeks ago and was present during the inspection.

Standard #: 8VAC20-780-340-F
Description: Based on observation the center failed to ensure that children under ten years old always are within actual sight and sound supervision of staff.
1 ? Staff #2 was observed leaving nine children in care when he left the room to open the door for arriving parents. Once Staff #2 was standing, holding the door open he was no longer within the classroom and could not see all the children in care inside the child care room.
a. The children present ranged in age from five through eight years.
b. Staff # 2 was observed leaving the child care room no less than four times.
2 ? Staff #3 left three children unattended on the kindergarten playground after leaving the playground with nine of the 12 children for which she was responsible.
a. Staff #3 could not visually see nor hear the activity on the playground from where she was standing with other nine children.
b. Staff #3 and nine children lined up and standing approximately 60 feet away from the gate that leads to the playground. The gate is located at the corner of the building. The playground sits behind and beyond the building. One by one, with a brief wait time between appearances, each of the three children walked through the gate and joined group that was lineup and waiting to go inside.
3 - While on the playground with 30 children it was impossible for Staff #4 to maintain sight and sound of all 30 children due to size and shape of the outside play space. The play space is in the shape of a backwards ?L?.
a. Staff #4 was observed moving around the space to meet the needs of the children as the need to move arose. The movements meant that while attending to children on the left side of playground no one was supervising children on the right side of the playground.

Standard #: 8VAC20-780-350-B-5
Description: Based on observation and interview the center failed to demonstrate that staff to child ratios are followed.
Evidence:
Upon arrival there were 30 children ranging in age from five to eight years old, lined up to go outside. Before going outside Staff #4 stated that he had 30 children in his group and was taking all 30 outside without any additional staff. The number of children in this group would require an additional staff to meet the required ratio of one staff to 18 children for this age group.
