Comments:
A complaint inspection was initiated on April 3, 2023 and concluded on April 28, 2023. A complaint was received in the Office of Child Care Health & Safety (Valley) on March 22,2023 regarding forbidden action. Interviews were completed with an outside agency on April 3,2023 and April 14, 2023. The inspector reviewed compliance in the areas of administration, staffing and supervision, and programming. One child record, four staff records, and video footage from 01/27/2023 and 03/16/2023 were reviewed. Eight staff interviews and classroom observations were conducted. The information gathered during the investigation does not support the allegation, so the complaint is determined to be ?not valid.?

There were two violations with applicable standards or law noted during the inspection. The violations are noted on the violation noticed issued to the program.

Description: Based on review of documentation and interviews, the center, who had reason to suspect child abuse or neglect, failed to report the matter immediately to the local department of the county or city wherein the child resides or wherein the abuse or neglect is believed to have occurred or to the Department's toll-free child abuse and neglect hotline.

Evidence:
1. The parent of Child #1 reported to Staff #1, via email dated 01/28/2023 at 7:00 A.M., that ?Child #1 had demonstrated and verbalized that Staff #3 squeezed his face/cheeks very hard and hurt him.?
2. The parent of Child #1 requested, via email dated 01/28/2023 at 2:55 P.M., a meeting with Staff #2 to ?review and discuss video footage regarding the physical assault of Child #1.? and indicated she ?noticed (Child #1) had a red mark on his face and it is now bruising.?
3. The incident was reported to Local Law Enforcement by the Parents of Child #1 on 03/22/2023. Local Law Enforcement notified Child Protective Services on 03/22/2023.

Plan of Correction: The center will report any indicated child abuse or neglect. Video footage on 1/28/2023 was reviewed immediately and team members interviewed. Child #1 was not alone and abuse was not suspected or believed to have occurred, but moving forward if indicated by a parent the center administration will call the departments toll free number. A phone call was placed to licensor on 03/02/2023.

Description: Based on observation, the center failed to ensure that children under 10 years of age always shall be within actual sight and sound supervision of staff.

Evidence:
1. In the Intermediate Blue Classroom that serves children three years of age, during naptime on April 3,2023 two children were observed on their mats behind the bookcase and one child was observed on a mat behind the shelf at the entrance to the classroom. These children were not within sight of the two staff who were sitting on the large, carpeted area of the classroom.
2. In the Pre-K Gold classroom that serves children four to five years of age, during naptime on April 3, 2023, two children were observed on mats located in the library area behind a shelf, one child was observed on a mat located near the restroom in front of a shelf, and one child was observed on a mat located by the sink area behind the table. These children were not within sight of the one staff member present in the classroom who was sitting on the carpeted area to the right of the classroom entrance.
3. In the Beginning Preschool Gold Classroom that serves children two years of age, during naptime on April 3, 2023, one child was observed on a mat located behind the diaper changing table, and three children were observed on mats located in the library area behind the shelf. These children were not within sight of the two staff in the classroom that were sitting on the carpeted area near the cubbies.

Plan of Correction: Team members were retrained on sleeping procedures. All napping areas will be within sight and sound supervision.
