Comments:

An unannounced monitoring inspection was conducted with the new Director and the Assistant Director from 10:35am to 3:05pm on 5/4/2023, in response to a self-report by the program regarding a forbidden action- striking a child. Video footage was reviewed, interviews were conducted, classrooms were observed, and one child record and two staff records were reviewed. Violations were cited in response to the inspection and can be reviewed on the Violation Notice. Please complete the "Plan of Correction" and "Date to be Corrected" areas on the Violation Notice for each violation cited and return to me by close of business on 5/19/23. Standard #:	22.1-289.035-B-4
Description:	Based on review of two staff records, the provider did not obtain the results of a search of the central registry for another state in which an employee lived in the previous five years within 30 days of employment. Evidence: The record for Staff #1, with an employment date of 7/18/22 contained documentation that the staff member had lived in the state of New York within the past five years. There was no documentation of the results of a search of the central registry from New York on record for the staff.
Plan of Correction:	Sent the NY background request. Will ensure all out of state checks are completed prior to start dates.
Standard #:	8VAC20-780-240-A
Description:	Based on review of two staff records, the center did not ensure that the Virginia Department of Education-sponsored orientation course (Preservice) was completed within 90 calendar days of employment for one staff. Evidence: The Preservice certificate on record for Staff #1, with an employment date of 7/18/22, was dated 10/27/22.
Plan of Correction:	Will ensure that all preservice training is completed within 90 days of new hires starting.
Standard #:	8VAC20-780-400-B
Description:	Based on review of video footage and interviews, the center did not ensure that behavioral guidance was constructive in nature, age and stage appropriate, and was intended to redirect children to appropriate behavior. Evidence: At approximately 10:33am on 5/2/23, Child A, two-years-old, was observed climbing on a toy shelf in the ?Beginner A? classroom. Staff #1 turned around and noticed the child on the shelf and the child began to come back down. As the child?s feet touched the floor, Staff #1 was observed to spank the child, one time, on the bottom.
Plan of Correction:	Teacher retrained on forbidden actions, abuse and neglect and a corrective plan of action was done.
Standard #:	8VAC20-780-410-1
Description:	Based on review of video footage and interviews, the center did not ensure that a forbidden action, striking a child, did not occur. Evidence: At approximately 10:33am on 5/2/23, Staff #1 was observed striking Child A, a two-year-old, on the bottom, one time.
Plan of Correction:	Retrained all staff on forbidden actions.
