Comments:
An unannounced inspection was conducted on 5/3/23 in response to a complaint received by the department on 4/27/23. The allegations made were related to a staff member hitting a child on two different occasions. Interviews were conducted with 3 center staff members, 3 children that attend the center, and one other witness from another educational institution. Attendance records, van logs, 1 staff record and 1 child's record was also reviewed as part of the investigative process. Based on the preponderance of evidence, the complaint was not valid. Description: Based on records review and staff interview, the center did not follow it's own policies as required by the standards.
Evidence:
1. The center's policies for "Reporting Child Abuse and Neglect" states that, "As teachers in a child day program, we are mandated reporters for suspected child abuse and neglect. If you have reason to suspect that a child is being abused or neglected, you must report it immediately to Child Protective Services of the county or city where the child resides or where you believe the abuse or neglect to have occurred. The Fairfax County CPS hotline is 703-324-7400".
2. Staff # 1 stated that on 4/26/23, Child # 1's parent informed Staff # 1 of an incident related to Staff # 2 and Child # 1.
3. Staff # 1 also stated that Child # 1's parent informed Staff # 1 of another allegation on 4/27/23 related to Staff # 2.
4. Staff # 1 and Staff # 3 confirmed that no one from the center called to report the incident to Child Protective Services.

Plan of Correction: Management met with child's parent. It was agreed that a report should be made to CPS and that the parent would report it. According to VA Code Title 63.2-1509 it states that "no person shall be required to make a report pursuant to this section if the person has actual knowledge that the same matter has already been reported to the local department..." Therefore it was my understanding that we did not need to report it since the parent was going to. Moving forward we will report all allegations regardless of knowledge that it has already been reported.
