Comments:
An unannounced non-mandated monitoring inspection was conducted March 30, 2023 and concluded May 4, 2023. The non-mandated monitoring inspection was in response to a self-reported incident regarding allegations in staffing and supervision on February 28, 2023. Interviews were conducted and documents were reviewed.

There were no violations related to the self-reported incident. Any violations not related to the self-report but identified during the course of the investigation can be found on the violation notice.

Please complete the ?plan of correction? and ?date to be corrected? for each violation cited on the violation notice and return it to me within 5 business days from today. Please specify how the deficient practice will be or has been corrected. Your plan of correction should contain: 1) steps to correct the noncompliance with the standard(s), 2) measures to prevent the noncompliance from occurring again; and 3) person(s) responsible for implementing each step and/or monitoring any preventative measures. Please do not use staff names; list staff by positions only.

Violations:
Standard #: 8VAC20-780-40-E
Description: Repeat Systemic Violation
Based on a review of records and staff interviews, the licensee failed to ensure that the center's activities, services, and facilities are maintained in compliance with the center's own policies and procedures that are required by these standards.
Evidence: 1. Page 5 of the center's behavior guidance policy titled "Respect and Protect Children," states "we only use positive child guidance techniques, staff are to be a good role model and work in a positive cooperative way, and intervene verbally, with a calm, gentle voice."
2. In an interview with staff #2 on March 20, 2023, it was stated that in February 2023, staff #2 witnessed staff #1 verbally say the following to children: a) "I don't like you." b) "I wish your parents would just come pick you up." c) "I hope this building would burn down with all you kids in it."
3. In an interview with staff #3 on March 20, 2023, it was stated that in February 2023, staff #3 witnessed staff #1 verbally say the following to children: a) "I hope this place burns down with all you kids in it." b) As a child was putting food in his mouth, "I hope you choke and learn your lesson." "I'm not going to save you if you do."

Plan of Correction: Staff meeting review our behavioral guidance and positive redirections. Also, continue to refresh periodically.

Description: Based on staff interviews, the center failed to ensure that in order to promote the child's physical, intellectual, emotional, and social well being and growth, staff shall interact with the child and one another to provide needed help, comfort, and promote ways of getting along.
Evidence: 1. In an interview with staff #2 on March 20, 2023, it was stated that in February 2023, staff #2 witnessed staff #1 verbally say the following to children: a) "I don't like you." b) "I wish your parents would just come pick you up." c) "I hope this building would burn down with all you kids in it."
2. Plan of Correction: Retrain on positive guidance. Check in on staff's well being.
