Comments:
An unannounced non-mandated monitoring inspection in response to an Intensive Plan of Correction was conducted on-site on May 2, 2023. The director was available during the inspection. There were 149 children present, ranging in ages from 3 months to 5 years, with 26 staff supervising. The inspector reviewed compliance in the areas of administration, physical plant, staffing and supervision, programming, special care and emergencies and nutrition. A total of 5 child records and 4 staff records were reviewed.

Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.

Please complete the ?plan of correction? and ?date to be corrected? for each violation cited on the violation notice and return it to me within 5 business days from today. Please specify how the deficient practice will be or has been corrected. Your plan of correction should contain: 1) steps to correct the noncompliance with the standard(s), 2) measures to prevent the noncompliance from occurring again; and 3) person(s) responsible for implementing each step and/or monitoring any preventative measures. Please do not use staff names; list staff by positions only.

Violations:
Standard #: 22.1-289.011-F
Description: Based on observation and interview on 05/02/2023, the licensee failed to ensure that any other documents required by the Superintendent shall be posted in a conspicuous place on the licensed premises.
Evidence: 1. The findings from the most recent inspection conducted 02/14/2023, was placed inside one clear protective sleeve behind an inspection dated 09/23/2022.
2. The contact notification was not posted at the facility, as required by the Special Order, dated 03/02/2023.
3. Staff #5 confirmed the findings and contact notification were not posted.

Plan of Correction: The steps taken to prevent violation(s) in the above area(s) from occurring in the future: The most recent inspection was brought to the front of the sleeve in presence of Licensing Representative. All necessary documentation has been placed in a prominent place, center door.

Standard #: 22.1-289.023-A
Description: Based on observation and interview on 05/02/2023, the licensee failed to ensure that a copy of the Notice of the Intent, dated 01/25/2023, was posted in a prominent place at each public entrance of the facility to advise consumers of serious or persistent violations.
Evidence: 1. All pages of the Notice of Intent were placed inside one clear protective sleeve behind an inspection dated 09/23/2022. 2. Staff #5 confirmed the Notice of Intent was located behind an inspection inside a clear protective sleeve.

Plan of Correction: The steps taken to prevent violation(s) in the above area(s) from occurring in the future: Notice of Intent has been placed in a prominent place, center door.

Description: Repeat Violation
Based on a review of staff records and interview on 05/02/2023, the center failed to ensure that each staff record reviewed contained a central registry finding within 30 days of employment.
Evidence: 1. The record of staff #3, hired 01/16/2023, contained central registry finding results dated 03/30/2023. 2. Staff #5 confirmed the central registry was late.

Standard #: 8VAC20-780-160-A
Description: Repeat VIolation
Based on a review of staff records and interview on 05/02/2023, the center failed to ensure that each staff submit documentation of a negative tuberculosis (TB) screening at the time of employment and prior to coming into contact with children.
Evidence: 1. The record of staff #3, hired 01/16/2023, contained documentation of a TB that was dated 01/26/2023.
2. Staff #5 confirmed that staff #3 was at the center on 01/16/2023, while children were in care.

Plan of Correction: The steps taken to prevent violation(s) in the above area(s) from occurring in the future: TB screening for Staff #3 in file since 1/26/2023.

Standard #: 8VAC20-780-60-A
Description: Repeat Violation
Based on a review of children's records and interview on 05/02/2023, the center failed to ensure that each child's record contained the required information.
Evidence: 1. The record of child #5 contained documentation of one emergency contact person and the phone number provided was the same phone number as the parent.
The record of child #5 did not contain documentation of the name, address, and phone number of a second designated person to call in an emergency if a parent can't be reached.
2. Staff #5 acknowledged the missing emergency contact information.

Two contacts have been listed with same address different phone number from parent.

Standard #: 8VAC20-820-120-E-6
Description: Based on observation on 05/02/2023, the licensee failed to ensure that a copy of any special order issued by the department shall be posted in a prominent place at each public entrance of the licensed premises to advise consumers of serious or persistent violations.
Evidence: A copy of the special order issued by the department on 03/02/2023 was not posted in a prominent place at the public entrance.

Plan of Correction: The steps taken to prevent violation(s) in the above area(s) from occurring in the future: Special Order has been placed in a prominent place, center door.
