An unannounced non-mandated monitoring inspection was conducted March 30, 2023 and concluded May 18, 2023. The non-mandated monitoring inspection was in response to a self-reported incident regarding allegations in forbidden actions on March 30, 2023. Interviews were conducted and documents were reviewed.
There were violations related to the self-reported incident. Any violations not related to the self-report but identified during the course of the investigation can be found on the violation notice.
Please complete the "plan of correction?" and "date to be corrected" for each violation cited on the violation notice and return it to me within 5 business days from today. Please specify how the deficient practice will be or has been corrected. Your plan of correction should contain: 1) steps to correct the noncompliance with the standard(s), 2) measures to prevent the noncompliance from occurring again; and 3) person(s) responsible for implementing each step and/or monitoring any preventative measures. Please do not use staff names; list staff by positions only.

Standard #: 8VAC20-780-40-E Description: Repeat Systemic Violation
Based on a review of records and staff interviews, the licensee failed to ensure that the center's activities, services, and facilities are maintained in compliance with the center's own policies and procedures that are required by these standards.
Evidence: 1. Page 5 of the center's unacceptable and acceptable discipline policy titled, "Respect and Protect Children," states "certain discipline methods are simply not acceptable at KCE, including: grabbing."
2. In an interview with staff #2 on 05/01/2023 it was stated that on 03/30/2023 staff #2 witnessed staff #1 grab child #1 by the upper part of the right arm, yank child #1 toward staff #1 and then force the child down to the ground. Staff #2 further stated that when she told staff #1 that it was too rough, staff #1 replied "I know, I was just trying to get him off of him."Plan of Correction: Continue to train staff on positive guidance. Review policies periodically. Conduct staff check ins.
Standard #: 8VAC20-780-410-1 Description: Repeat Violation
Based on document review and staff interviews, the center failed to ensure that roughly handling a child is forbidden.
Evidence: 1. In an interview on 05/01/2023, staff #2 stated that on 03/30/2023 staff #2 witnessed staff #1 grab child #1 by the upper part of the right arm and "yank" him towards staff #1 and "forced him down to the ground." Staff #2 further stated she told staff #1 not to yank child #1's arm, that it was too rough and staff #1 replied to staff #2 by saying, "I know, I was just trying to get him off of him."
2. Staff #3 confirmed that staff #1 was terminated as a result of the incident.Plan of Correction: Review forbidden actions with all staff. Terminated staff #1 3/30/23.
