Technical Assistance:
Training was conducted 3/16/2023 via Zoom regarding paperwork requirements for children and staff. (12:00PM - 2:00PM). Required policies and procedures were also reviewed at that time.

Comments:
A complaint investigation was initiated on 3/20/23 into a report received in our office on 03/07/23 and 03/08/2023. The preponderance of evidence supports the allegation of a lack of supervision. The complaint is therefore deemed valid.

Additional violations were cited that were not part of the original complaint; however, they were found during the course of the investigation.

Most violations were reviewed with admin staff during the onsite exit interview. One additional violation (cot spacing and top and bottom covers) was reviewed with the center owner by phone within 10 minutes of leaving the center.

Description: Based on a review of policies and procedures, the center did not ensure that the center?s activities, services and facilities were maintained in compliance with the center?s own policies and procedures that are required by these standards.
Evidence:
Regarding the center?s medication policy, the parent handbook states: ?If the medication is not picked up in two weeks or is expired, the Center will dispose of the medication.? Child 1?s Epi-pen at the center expired on 11/2022 and was not disposed of.

Description: Based on an interview and a review of records, one of two children?s records did not contain all required information.
Evidence:
1. Administrator stated that no original documentation of proof of identity and age was reviewed for Child 2. The documentation viewed and on file was a copy of the child?s passport that the parent provided.
2. The 2 emergency contacts listed for Child 2 are the child?s parents instead of 2 designated people to call in an emergency if a parent cannot be reached.

Description: Based on observation and interview, children under 10 years of age were not kept within actual sight and Sound supervision.
Evidence:
At approximately 1:40pm, Staff A was observed walking into the ?Mindfulness room? (Room 2 on the floor plan). There were 9 resting children in the room and no additional staff member present in the room. Staff A stated they left the room because they ?Had to turn off the lights?.

Evidence:
Children were resting on cots in the ?Mindfulness room? (Room 2 on the floor plan map). Two cots were touching, with additional cots spaced approximately 3-4? apart.

Description: Based on observation, medication was not stored in a locked place, using a safe locking method that prevents access by children.
Evidence:
Child 1?s Epi-pen was stored in a plastic ?ziplock? baggie, in a TEA Center backpack that was placed on the bench seat in the entry way to the facility. This area is used by children entering and exiting the building.
