Technical Assistance:

The applicant must send evidence to the licensing inspector that the background checks have been requested no later than 10 days of this notification dated 5/30/2023. The applicant must also then forward the results to the licensing inspector upon receipt. The following need to be received BEFORE you can hire someone: fieldprint fingerprint results completed sworn statement If the person has lived outside of VA within the past 5 years you need their out-of- state criminal background search results and the sex offender registry search results from any state they have resided in. Staff are not permitted to work until satisfactory fingerprint results are received. Pay attention to the surfacing material under and around the swings. If grass grows in the material, it becomes compacted and is no longer "resilient".

Comments:

A monitoring inspection was initiated and concluded on 5/26/2023 There were 44 children present with 8 staff supervising.The inspector reviewed compliance in the areas of administration, physical plant, staffing and supervision, programming, medication, special care and emergencies and nutrition. A total 5 child records and 5 staff records were reviewed. The inspection started at 3:15 pm and concluded at 5:10 pm. Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program

Violations:

Standard #:	22.1-289.035-B-2
Description:	* REPEAT VIOLATION* Based on a review of records and interview, the licensee did not always ensure that the results of a Federal Fingerprint based Criminal Record Search are obtained prior to employment or volunteer service. Evidence: Five staff records were reviewed. The record for staff #5, whose date of employment was documented as 4/25/2023, did not contain the results of a Criminal History Search. Staff #5 was working alone in a classroom with 7 children ages 5-7 years old at the time of the inspection. Staff #6, who was in charge of the center at the time of the inspection, confirmed that this documentation was not present in staff #5's record.
Plan of Correction:	The Program Director will follow up to see if the Criminal History Report is being processed by the Office of Background Investigations (OBI) and document the correspondence. If OBI has not received the fingerprints for processing, then a new appointment for fingerprints will be set.. A copy of the correspondence or a copy of the new appointment confirmation will be forwarded to the inspector within 10 days.

Staff #6, who was in charge of the center at the time of the inspection, confirmed that this documentation was not present in staff #5's record.

If OBI does not have the request, then a new request will be sent within 10 days.
