63.2 Child Abuse & Neglect

Comments:
A complaint was received by the Fairfax Licensing office on 5/16/2023 regarding care and protection of children. On 5/18/2023, an investigation was initiated, in the morning between 9:15 am and 9:53 am. Staff were interviewed, and documents were reviewed. The investigation was completed on 6/5/2023. It was determined that the preponderance of evidence supported the allegation, and the complaint is deemed valid. For violation details, please refer to the Violation Notice. Description: Based on staff interview, the center failed to inform the department's representative as soon as practicable, but not to exceed two business days, of any injury to a child that occurs while the child is under the supervision of the center and requires outside medical attention.

Evidence:
1. On Tuesday, May 16, 2023, an outside source notified the department of an injury Child #1 (two-years-old) sustained under the supervision of the center on Tuesday, May 2, 2023.

2. Child #1(two-years-old) sought outside medical attention for the burns that were caused due to the hot tea being spilled on them.

3. On Wednesday, May 3, 2023, Staff #2 confirmed they were made aware that Child #1(two-years-old) received outside medical attention, but the center did not notify the department?s representative within the required time frame.

4. Staff#2 stated that they were also unaware that they were required to notify the department's representative as soon as practicable, but not to exceed two business days, of any injury to a child that occurs while the child is under the supervision of the center and requires outside medical attention.

Plan of Correction: Corrected Immediately

Staff did have communication with parents for the 2 days following the incident when their 2nd child was brought into the Center for care. In addition, Center's Director phoned the parents to check on Child #1's wellbeing for the 2 days following the incident and left voice messages expressing concern and compassion the parents did not inform the Center that Child #1 needed to receive outside medical evaluation until 3 days after the incident.

Center was not aware that Child #1 had been taken for outside medical treatment until day 3, or 72-hours following the incident, parent informed staff of this treatment as their 2nd child was being dropped off at the Center. This information became known to the Center outside of the time frame we would have been required to report this incident to licensing.

Staff has been reminded that any future incidents requiring outside medical attention or treatment must be reported to licensing as soon as practicable, but not to exceed two business days.

Description: Based on multiple interviews, medical documentation, and photographs, the center failed to ensure their care and protection, when supervising children.

Evidence:
1. On Tuesday, May 2, 2023, at approximately 9:30 am, Child #1 (two-years-old) ran into Staff #1 who was holding a thermos cup filled with hot tea. Tea spilled out of the spout of the thermos cup and onto the right side of Child #1?s ear, face, and upper chest causing burns.

2. Medical documentation from the emergency room and burn clinic was reviewed and the document states Child #1 suffered superficial burns and partial thickness burns of multiple sites.

Plan of Correction: Corrected Immediately

Proper supervision and ratios per childcare standards were in effect at the time of the referenced incident. Staff #1 was at a reasonably safe distance across the classroom, however not presently interacting with students.

Seeing Staff #1 from across the room Child #1 become excited and charged across the classroom at full force embracing the legs of Staff #1. The unexpected impact resulted in Staff #1 losing her balance and falling forward sloshing the tea she had been drinking onto the head, ear, and shoulder of Child #1.

Routinely, staff instruct and practice with the children proper behavior in the classroom which includes being aware of other's around you and prohibited running with the classroom. This is a learning process that takes time and repetitive proactive with the children.

Staff #1, along with all teachers, assistant teachers and other staff have been reminded of Horizon's school policy allowing only room temperature beverages within the classrooms. Written notices have been posted throughout the Center prohibiting staff from consuming beverages that are above room temperature at any time when in vicinity of children.
