An unannounced complaint inspection was conducted on 5/17/2023 from 10:20am to 1:25pm in response to a complaint that was received by the department regarding rest time ratios, staffing and supervision. Staff interviews, documentation review, and observations were made. The preponderance of evidence does support a valid finding regarding standards related to staffing and supervision. Areas of non-compliance are identified on the Violation Notice.

Standard #: 8VAC20-780-350-B-1 Complaint related: No Description: Based on review of documentation and information obtained during interviews, the center did not ensure that the staff-to-child ratio of one staff for every four children was maintained in the infant classrooms.
Evidence:
1. During interviews, the center's staff reported that during the designated rest time and when staff members took their breaks, the infant classrooms did not maintain a ratio of one staff member for every 4 children.
2. There were 12 children enrolled and 3 staff members assigned to the Caterpillar classroom. Staff #1, Staff #2 and Staff #3 were scheduled to start taking their breaks at approximately 12:30pm, 1:00pm and 1:30pm respectively.
A) When Staff #1 took their break, at approximately 12:30pm, up to 12 children were left with Staff #2 and Staff #3 for 30 minutes from 12:30pm to 1:00pm.
B)When Staff #2 took their break at approximately 1:00pm, Staff #3 was left with up to 12 children for approximately 30 minutes from 1:00pm to 1:30pm.
C)When Staff #3 took their break at approximately 1:30pm, Staff #1 and Staff #2 were left with up to 12 children for approximately 60 minutes from 1:30pm to 2:30pm.
3. There were 9 children enrolled and 3 staff assigned to the Little Lambs classroom. Staff #4, Staff #5 and Staff #6 were scheduled to start taking their breaks at approximately 12:30pm, 1:30pmand 2:30pm respectively.
A) When Staff #4 took their break, at approximately 12:30pm, up to 9 children were left in the care of Staff #5 and Staff #6 for 60 minutes from 12:30pm to 1:30pm.
B) When Staff #5 took their break at approximately 1:30pm, Staff #4 and Staff #6 were left with up to 9 children for approximately 30 minutes from 1:30pm to 2:00pm. At 2:00 pm one of the 9 children attending is scheduled to leave the center making the ratio for the classroom 2 staff members for 8 children.
4. During the designated rest period, the staff-to-child ratio for infant children is one staff member for every four children, ratios do not change for children under 16 months of age.Plan of Correction: Those primarily responsible for assigning coverage to provide the opportunity for caregivers/educators to have time outside the care setting to tend to their personal needs/matters as well as all caregivers/educators assigned or provide care and coverage for school families in the infant department were made aware that the FBCC CDC was in violation of the ratio standards/requirement that 1 caregiver/educator must be present at all times, including when children are sleeping/napping at the time of the inspection.
At a professional growth and development meeting 25 May 2023, all caregivers - teachers were made aware of the standard/requirement for ratio for every 4 children under the age of 16 months to have 1 adult with them at all times including when sleeping/napping. Other ratio matters and issues were discussed as well.
They willingly accepted the responsibility to insure such and agreed the requirement/standard would be addressed and adhered to immediately.
Aware and committed to maintaining the required ratio, working in orchestration with administration and faculty those primarily responsible for assigning coverage have done so utilizing members of the resource faculty and administration.
Since day after the inspection which was conducted 17 May 2023, (18 May 2023) the required ratio of 1 caregiver/educator (staff member) for every 4 children in care setting including when the children are sleeping/napping has been and will continue to be maintained.
