Comments:
The licensing inspector conducted an unannounced monitoring inspection on 06/02/2023 In response to a self report t that was received in the licensing regarding allegations in the area of Supervision. Interviews were conducted with staff, records reviewed and observations of the program were made relating to the allegation. Information gathered during the inspection determined non-compliance(s) with applicable standards or law and violations were documented on the violation notice issued to the program.

Violations:
Standard #: 8VAC20-780-40-E
Description: Based on interviews and a record review the center did not ensure the center's activities were
maintained in compliance with these standards and the center's own policies and procedures that are required by these standards.

Evidence:
1. As part of the center's supervision policy staff are required to complete a "face-to-name" check of the children in their care on an hourly basis and before and after transitioning children from one area of the center to another. Staff are required to see he child's face and say their name to confirm all children are accounted for followed by marking it on a "face-to-name" sheet.

2. On 05/16/2023 Staff #1 and #2 took 4 toddlers to the playground and returned back to the classroom with only 3 children. The director confirmed all 4 children were marked as accounted for, however neither staff performed an actual face-to-name check of the children when they came back to the classroom.

Plan of Correction: The following corrective actions were provided by the center:
staff members 1 and 2 were placed on administrative leave. After investigation both staff members were terminated from the company on 5/25/2023 effective immediately. On 5/17/2023 all other staff members were retrained on face to name policy and proper child supervision. School leadership will be doing unannounced classroom observations to ensure compliance until further notice

Standard #: 8VAC20-780-330-B
Description: Based on observation the center did not ensure where playground equipment is provided, resilient surfacing shall comply with minimum safety standards when tested in accordance with the procedures described in the American Society for Testing and Materials standard F1292-99.

Evidence:
1. The 2 composite play structures on the playground did not have the required resilient surfacing.

a. There was approximately 2 inches of mulch in the fall zones, were 6 inches is required.
b. Grass and vegetation was observed growing in the fall zone areas of both pieces of equipment.
c. The preschool play structure had a large root exposed at the base of the slide.

Plan of Correction: The following corrective actions were provided by the center:
This will be corrected in 30 days. Going forward the playground will be inspected by opening staff and all deficiencies will be reposted to management within 24 hours. Management will ensure all issues are handled and reported in a timely manner. Management will do periodic inspections to ensure compliance.

Standard #: 8VAC20-780-340-A
Description: Based on observation the center did not ensure when staff are supervising children they shall always ensure their care, protection and guidance.

Evidence:
1. On 05/16/2023, The center did not ensure the care, protection and guidance of child #1 when he was left on the playground for approximately 15 minutes and not discovered until the child's parents arrived to pick him up.

2. Staff reported child #1 was found outside tapping on the outside door to his classroom and crying. Staff described him as visibly "upset."

Plan of Correction: The following corrective actions were provided by the center:
staff members 1 and 2 were placed on administrative leave. After investigation both staff members were terminated from the company on 5/25/2023 effective immediately. On 5/17/2023 all other staff members were retrained on proper child supervision to ensure all children are always within sight and sound. School leadership will be doing unannounced classroom observations to ensure compliance until further notice.

Standard #: 8VAC20-780-340-F
Description: Based on interviews the center did not ensure children under 10 years of age were always within sight and sound supervision of staff.

Evidence:
1. Center staff reported to the licensing office that Child #1 was left alone and unsupervised on the playground on the afternoon of 05/16/2023.
2. Staff #1 and #2 were out on the playground supervising 8 children from the toddler room and they returned to the classroom at approximately 4:40pm. At approximately 4:57pm the parent of Child #1 came to pick them up, and Child #1 was not in their classroom. Child #1 was then found by the director alone and unsupervised on the playground.

Plan of Correction: The following corrective actions were provided by the center:
Staff members 1 and 2 were placed on administrative leave. After investigation both staff members were terminated from the company on 5/25/2023 effective immediately. On 5/17/2023 all other staff members were retrained on face to name policy and proper child supervision. School leadership will be doing unannounced classroom observations to ensure compliance until further notice
