22.1 BACKGROUND CHECKS CODE; CARBON MONOXIDE

Comments:
An unannounced monitoring inspection was conducted from 10:15 am to 12:30 pm. At the time of entrance, 46 children were in care with 13 staff members supervising. Additional staff were present for administrative duties. The sample size consisted of 5 children?s records and 5 new staff records. Children were observed eating lunch, participating in a in-house field trip and playing freely. Areas of non-compliance are identified on the violation notice.

Violations:
Standard #: 22.1-289.035-B-4
Description: Based on review, facility did not ensure when an employee has lived outside the state of Virginia within the past 5 years, background checks are completed for those states.

Evidence: The following was found during record review:
1. The record for staff #1 (start date 4/17/2023) did not have a child abuse/neglect registry search for a state the individual has lived in within the past 5 years.
2. The record for staff #2 (start date 5/30/2023) did not have a criminal history search for a state the individual has lived in within the past 5 years.
3. The record for staff #3 (start date 4/24/2023) did not have a criminal history search and child abuse/neglect registry search for 2 states the individual has lived in within the past 5 years.

Plan of Correction: 1. Staff #1 paperwork was resent.
2. Staff #2 proper paperwork was sent and in communication with someone in DES making sure it is completed properly.
3. Staff #3 paperwork was sent to portal and making sure proper background checks are done.

Standard #: 8VAC20-780-140-A
Description: Based on review, facility did not ensure 1 of 5 child records has a physical examination within 30 days of beginning attendance.

Evidence: The record for child #5 (start date April 24, 2023) did not have a physical.

Plan of Correction: Parent provided a health record from doctor 6/8/2023 as well as enrollment was updated on paper work on spot.

Standard #: 8VAC20-780-160-A
Description: Based on review, facility did not ensure 2 of 5 staff have a negative tuberculosis test or screening dated within 30 days prior to beginning employment.

Evidence: The following was found during record review:
1. The record for staff #2 (start date 5/30/2023) had a TB screening dated 2/23/2023.
2. The record for staff #5 (start date 5/30/2023) had a TB screening dated 6/1/2022.

Plan of Correction: Going forward staff TB screenings will be check properly making sure it is no more than 30 days before start date.

Standard #: 8VAC20-780-70
Description: Based on review and interview, facility did not ensure 1 of 5 staff records has documentation of required staff orientation training.

Evidence: The record for staff #4 (start date April 17, 2023) did not have documentation of orientation training. Director stated the training was completed but the form was not available in the record.

Plan of Correction: Staff #5 paperwork was placed in her file 6/8/2023 evening.

Standard #: 8VAC20-780-340-D
Description: Based on observation and review, facility did not ensure in each grouping of children at least one staff member who meets the qualifications of a program leader or program director is regularly present.

Evidence: Staff #3 was present with 4 children in the Infant B classroom. There was not documentation of program leader or program director qualifications in the staff record. Director stated the individual is not program leader qualified.

Plan of Correction: Staff will follow under 8VAC20-780-210 program leader qualifications #4 until completed CDA classes. A teacher with qualifications was placed in the room.

Standard #: 8VAC20-780-500-B
Description: Based on observation, facility did ensure required items are available in the diapering area and the diapering surface is used only for diapering or cleaning children.

Evidence: The following was observed:
1. Diapering areas in the facility had a open basket for soiled linens when a covered receptacle is required.
2. The changing table in the Toddler A classroom had toys and puzzles sitting on the surface.

Plan of Correction: Staff was retrained on making sure changing area stay clean at all times.
