Comments:
A complaint investigation was initiated on 3/24/2023 and concluded on 6/5/2023 regarding a complaint involving a child injury received by the department on 3/21/2023. One staff was interviewed via telephone. Two staff were interviewed on site on 4/20/2023 and contact information for two involved or witness staff who were not at the center was obtained. An additional staff was interviewed on site 6/5/2023. There were 50 children present with 8 staff supervising during the onsite inspection on 4/20/2023. On 6/5/2023, there were 38 children present with 9 staff. The inspector reviewed compliance in the areas of administration, physical plant, staffing and supervision, medication, special care and emergencies. Classroom observations were conducted on 4/20/2023. Documentation related to the complaint as well as 5 child records and 7 staff records were also reviewed on this date.
The onsite inspection on 4/20/2023 started at 11:30 am and concluded at 3:45 pm. The onsite inspection took place from 12:00 pm to 1:15 pm on 6/5/2023.
Information gathered during the investigation determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program. Therefore, the complaint is deemed valid.

Description: Based on interviews and a review of documentation, the licensee did not inform the department, as soon as possible, but not to exceed two business days, of an injury to a child that occurred while the child was under the supervision of the center and required outside medical attention.
Evidence:
An incident report dated 2/3/2023, describes child #1 sustaining an injury to his arm when he was running and staff #1 tried to stop him.
During a telephone interview on 6/4/2023, staff #1 stated that at approximately 10:00 p.m. on 2/3/2023, child #1?s mother informed her via the center?s messaging application that she had taken child #1 to the doctor to have his dislocated elbow ?put back into place?.
Staff #1 stated that messages on this application are available to all center employees, but that she also informed her supervisor that the child had received medical treatment and forwarded information that child #1?s mother sent to her about ?nurses? elbow? and how it can occur in young children.
The program did not inform the department of this injury which occurred while the child was under the supervision of the center and required outside medical attention.

Plan of Correction: The program's administrator (staff #2) stated that she has located the web portal for reporting injuries that require outside medical treatment and will report, either through the portal or via telephone, within 2 business days, any future injuries incurred by children in care which require medical treatment.

Description: Based on interviews and a review of documentation, the licensee did not always ensure that when staff are supervising children, they always ensure their care protection and guidance.
Evidence:
A three year old child (child #1) sustained an injury to his arm while in care on 2/3/2023.
An incident report, completed by staff #1 who was supervising child #1, says that child #1 was running, when staff #1 ?tried to stop him? and ?unintentionally hurt his arm?.
In a telephone interview on 6/4/2023, staff #1 stated that child #1 was playing and was a ?rough kid? jumping off of the table and running around?, Staff #1 stated that she was ?dragging his arms and he was laughing ? then he started to cry. I called his mother? I understood it was my fault?.
The child was taken for medical evaluation that evening and treated for ?nurses elbow? which involved resetting the dislocation.

Plan of Correction: The program's administrator (staff #2) stated that this type of injury was described and discussed at the following staff meeting in March and staff were reminded and re-trained to pick up children by their torso and never by their arms. Staff #2 stated that this will be reinforced with reminders and training at each staff meeting going forward.
