Comments:
A monitoring inspection was conducted Wednesday, June 21, 2023. The licensing inspector was onsite, completing the inspection from approximately 10:10am until 2:30pm. There were 64 children present, ranging in ages from five months to 9 years, with 11 staff supervising. The inspector reviewed compliance in the areas of administration, physical plant, staffing and supervision, and medication. A total of six children's records and six staff members? records were reviewed.

Information gathered during the inspection determined non-compliance with applicable standards or law and a violation was documented on the violation notice issued to the program.

The provider must send documentation to the licensing inspector that required background checks have been requested no later than 10 days from the date of this notification - June 21, 2023.

Please complete the ?plan of correction? and ?date to be corrected? for each violation cited on the violation notice and returned it to me within five business days from today. Your plan of correction should contain: 1) steps to correct the noncompliance with the standard(s), 2) measures to prevent the noncompliance from occurring again; and 3) person(s) responsible for implementing each step and/or monitoring any preventive measure(s).

Violations:
Standard #: 22.1-289.035-B-4
Description: Based on review of six staff records and interview, the center did not request the results of a sex offender registry check and a search of founded complaints of child abuse or neglect within the required timeframes from all the states in which the one staff member had resided in the preceding five years.

Evidence:
1. The record for Staff #6 (Date of employment 04/05/2023) indicated the staff had resided in another state outside of Virginia within the last five years. The record did not contain documentation of a sex offender registry check and documentation a request for an out of state child abuse and neglect search.
2. Staff #6 confirmed residing in another state outside of Virginia during the last five years and was observed working and being counted in the staff-to-child ratio during the inspection.
3. Documentation of an out of state sex offender registry is required to be obtained prior to being hired. Documentation of a requested for an out of state child abuse and neglect search by the end of the 30th day employment.

Description: 60-A
Based on review of six children's records, the center did not obtain the required information for one child.

Evidence:
The record for Child #6 (first date of attendance 06/04/2023) did not contain written agreements between the parent and the center including authorization for emergency medical care should an emergency occur when the parent cannot be located immediately unless the parent states in writing an objection to the provision of such care on religious or other grounds; a statement that the center will notify the parent when the child becomes ill and that the parent will arrange to have the child picked up as soon as possible if so requested by the center; and a statement that the parent will inform the center within 24 hours or the next business day after his child or any member of the immediate household has developed any reportable communicable disease, as defined by the State Board of Health, except for life threatening diseases which must be reported immediately. The record for Child #6 did not contain documentation of viewing proof of the child's identity and age.

Standard #: 8VAC20-780-60-A-8
Description: Based on review of six children?s records, the center did not have a written allergy action care plan for one child diagnosed with a food allergy, to include instructions from a physician regarding the steps to take in the event of an allergic reaction.

Evidence:
The record for Child #4 (first date of attendance 02/21/2023) indicated the child has a diagnosed food allergy. Two staff members stated the written allergy action care plan had been requested but the family has not provided the document as of 06/21/2023.

Standard #: 8VAC20-780-70
Description: Based on review of six staff records, observation, and documentation review, the center did not keep the required records for three staff.
Evidence:
1. The records for Staff #5 (Date of Employment 03/23/2023) and Staff #6 (Date of Employment 04/05/2023) did not contain documentation of staff completing required orientation. Staff #5 and Staff #6 were observed working and being counted in the staff-to-child ratio during the inspection.
2. Two members of management stated Staff #5 and Staff #6 completed the required orientation. The documents could not be located during the 06/21/2023 inspection.
3. Staff #1 (Date of Employment 07/11/2022) was identified as a program leader during the inspection. The record of Staff #3 did not contain documentation of education required for the job position. Staff #1 was observed working and being counted in the staff-to-child ratio during the inspection.
