A complaint was received in the licensing office on May 2, 2023 regarding infant children asleep on bobby pillows while laying on their stomach. On May 4, 2023, an on-site investigation was conducted. Interviews were conducted and observations were made.
Based on the preponderance of evidence gathered, violations were cited. For violation details, please refer to the Violation Notice.

Standard #: 8VAC20-780-40-E Complaint related: Yes Description: Based on staff interviews and documents, the staff did not follow the operational responsibilities of the licensee by ensuring that the center's activities, services, and facilities are maintained in compliance with these standards, the center's own policies and procedures that are required by these standards, and the terms of the current license issued by the department.
Evidence:
1. On April 24, 2023, Staff #1 did not follow center?s infant safe sleep policy.
2. The center?s safe sleep policy requires that staff use infants will always be placed on their backs to sleep, unless medial documentation is present in the file sating otherwise.
3. The center?s safe sleep policy requires that infants will be moved to their beds if they fall asleep in a swing or bouncy seat, or any other area besides an infant crib.
4. Child A (3-month-old) was observed asleep on a bobby pillow face down.Plan of Correction: Implemented an infant/toddler renewal training. Reviewed safe sleep protocol and other health and safety guidelines.
Standard #: 8VAC20-780-340-A Complaint related: Yes Description: Based on interviews, documentation and video recordings, the center did not ensure that when staff were supervising children, they always ensure their care, protection, and guidance.
Evidence:
1.Child A (3-month-old) date of enrollment 4/24/2023 was on lying face down on a bobby pillow.
2. Child A did not have documentation in the classroom or in child?s record that Child A was able to turn themselves over.
3.Child A had active movements with legs kicking while on the bobby pillow. Child A legs movements stopped, and Child A feel asleep on the bobby pillow face down. It was undetermined how long Child A was asleep.Plan of Correction: Administered a corrective action for this specific teacher. Provided posters and materials on safe sleep.
