Comments:
An unannounced inspection was initiated on 6/26/2023 in response to a complaint that was received by the licensing department on 6/21/2023 regarding allegations in the area of nutrition and food services. The inspection was initiated on 6/26/2023 and completed on 6/29/2023. On 6/26/2023, the inspector was on site from approximately 9:40 am to 11:08 am. Interviews with staff were completed, observations were made in the center, and documentation was reviewed. Additional documentation was reviewed remotely.

The preponderance of the evidence gathered during the investigation supports part of the allegation; therefore, the complaint is determined to be valid. See the violation notice for more details.

You will need to specify how the deficient practice will be or has been corrected. Just writing the word corrected is not acceptable. Your plan of correction must contain: 1) steps to correct the noncompliance with the standard(s), 2) measures to prevent the noncompliance from occurring again; and 3) person(s) responsible for implementing each step and/or monitoring any preventative measures. Description: Based on a review of documentation and interview, the center did not ensure that when choosing to provide meals and snack, they followed the most recent, age-appropriate nutritional requirements of the Child and Adult Care Food Program of the United States Department of Agriculture (USDA).

Evidence:
1. On 6/26/2023, the inspector reviewed a menu that included June 5th-9th, June 12-16th and June 19-23rd. Of the 15 days reviewed, nine (9) breakfast meals did not meet the requirements. Breakfast must consist of three (3) components to include fluid milk, a vegetable, fruit or portions of both, and a grain. Nine (9) breakfast meals were observed to be missing the fruit or vegetable component.
2. Of the 15 days reviewed, four (4) snacks did not meet the requirements. Snacks are required to consist of two (2) of the five (5) components which are fluid milk, meat or meal alternatives, vegetables, fruits, and grains. Grain-based desserts do not count towards meeting the grains requirement. On four (4) days: cookies, a grain-based dessert, were served which resulted in the snacks containing only one (1) of the two (2) required components.
3. Of the three (3) weeks reviewed, the menu did not identify at least one (1) serving per day of a whole grain rich component as required.
4. Administration acknowledged that the menus did not meet the requirements of the Child and Adult Care Food Program of the United States Department of Agriculture (USDA). Administration stated that they had been in the process of revising their menus and food policies.

Plan of Correction: During Covid, all USDA requirements were waived due to a number of different reasons. In the middle of May, administration was made aware that our menu needed to be revised to align with the USDA standards. Administration began revising our menu to make sure it met all requirements as well as making sure we could find the necessary food items in local stores, etc. During the week of June 19th, administration sent our licensing inspector our revised menu to get them approved before notifying our parents. Our revised menu was approved by our licensing inspector on Thursday, June 29, 2023 and we will begin implementing the new menu on July 17, 2023. This will give us time to notify all parents of the change. Just to note: We do serve a fruit with each of our breakfast but it was not listed on the menu. Also, we do serve whole grain food items but they are not specified on our menu. Items include bread, pasta, etc. We have also taken out all grain-based desserts and replaced them with a healthier option. In the future, the administration will review our menu annually to make sure it aligns with all standards.
