Comments:
An unannounced complaint inspection was initiated by a local agency representative and inspector on June 7, 2023 and completed on June 29, 2023 regarding concerns of Staffing/ Supervision, Special Care Provisions/Emergencies, Administration and Programs. There were observations of parent drop off, children playing outside and infants resting and involved in free play.

During the inspection the following were completed: interviews with administrative staff, center staff, a review of records/documentation, observation of the classroom and area in which the incidents occurred, and a review of related text messages. Additionally, there were staff and collateral interviews, and a review of pertinent documentation during the investigative process. The preponderance of the evidence gathered during the investigation does support the allegation related to Special Care Provisions/Emergencies and therefore, the complaint is determined to be valid.
The inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program. Additional areas of non compliance, not complaint related were cited in the area of Administration and Staffing/ Supervision.

Standard #: 8VAC20-780-80-A
Complaint related: No
Description: Based on documentation review and provider interview the licensee did not ensure that for each group of children, the center shall maintain a written record of daily attendance that documents the arrival and departure of each child in care as it occurs.

Evidence: On May 1st in the infant room, during the centers designated nap time there were 12 children in the infant room and the attendance list for the infant room only listed 10 children. Staff#1 confirmed Child #1 and Child #2 were in the infant room, however they were not listed on the daily attendance for that group of children.

Plan of Correction: All children will be listed on class attendance sheet even if visiting a classroom for a short period of time whether the yare moving from another room with staff members to be accounted for in ratio.

Complaint related: No
Description: Based on staff interviews, center documentation and review of video footage, the licensee did not ensure the staff-to-children ratio one staff or every four infant children was followed.
Evidence: On May 1, 2023 between approximately 12:00 PM and 1:00 PM there were 12 children in the infant classroom with only two staff (Staff #1 and Staff #2). The age range of children in the infant room was 4 months (Child #3) and to age 4 (Child #2).

Plan of Correction: For future we will make sure there is enough staff during staff lunch breaks when napping is occurring. When adding kids above the room age we will ensure ratio to student is accurate.

Complaint related: Yes
Description: Based on interviews with staff and other parties involved, center documentation and a review of text messages, the licensee did not ensure the center shall notify the parent by the end of the day of any known minor injuries.

Evidence: On May 4, 2023, Child #1, age 3 was picked up from the center at approximately 4:05 and when the child?s parent was putting Child #1 in their car seat, they noticed an abrasion on the child?s chin and a scratch mark on their cheek. The parent and Child#1 walked back into the center and the parent spoke to Staff #3. Staff #3 did verify with the parent that Child #1 had had told them earlier in the day ?I fell?. Then Child #1 told Staff #3 and their parent they were running and then they pointed to the door frame of the hallway bathroom and they said ?I fell?. Text messages between Child 1#?s parent and Staff #1 confirm that two center staff had observed on May 4, 2023 the marks on Child #1?s cheek but not on their chin. The center did not notify Child #1?s parent of the injury.

Plan of Correction: For future center will ensure that parents are notify on all minor injuries even if staff did not see anything. If a child says they fell just just notify parents what the child says. Even if no one witness the incident.
