Comments:
An unannounced monitoring inspection was conducted on June 23, 2023 from approximately 1:55 pm to 2:55 pm in response to a self-report that the Office of Child Care Health and Safety received on June 16, 2023 regarding behavioral guidance. The center director was available throughout the inspection to answer any questions.

A total of 93 children were in care at the time of the inspection with 15 staff supervising. The inspector reviewed compliance in the areas of administration and programs. Three staff were interviewed during this inspection.

Information gathered during the inspection determined non-compliance with applicable standards or laws and violations were documented on the violation notice issued to the program.

Please complete the plan of correction and date to be corrected for each violation cited on the violation notice and return it to me within 5 business days from today.

Please specify how the deficient practice will be or has been corrected. Just writing the word corrected is not acceptable. Your plan of correction must contain: 1) steps to correct the noncompliance with the standard(s), 2) measures to prevent the noncompliance from occurring again; and 3) person(s) responsible for implementing each step and/or monitoring any preventative measures. Please do not use staff names; list staff by positions only.

Violations:
Standard #: 8VAC20-780-40-E
Description: Based on interviews, video and documentation review, the center did not ensure that their own discipline policies and procedures were followed as required by the Standards.

Evidence:
1. On 06/16/2023, the center?s director, self-reported an incident that occurred on 06/15/2023 where Staff #1 was observed on video ?pulling? Child #1.
2.The center?s procedures on Managing Challenging Behaviors states, ?The use of physical, mental, or emotional punishment on or demeaning behavior toward any child is prohibited.?
3.The procedures also state, ?No staff member is permitted to utilize the following means of punishment or redirection on any child, including his/her own or a relative?s child, while on company property. Hitting, shaking, biting, pinching, pulling, pushing, physical force or inflicting any other form of corporal punishment to hurt a child.?
4. A video was provided by the center on 06/23/2023 where, Staff #1 was observed, pulling Child #1 by the wrist resulting in the child falling to his knees.
5. During an interview with Staff #2 on 06/23/2023, it was acknowledged, that Staff #1 was observed pulling Child #1 towards her.

Standard #: 8VAC20-780-410-1
Description: Based on a review of video recording provided by the center and staff interview, the center failed to ensure roughly handling of a child was forbidden.

Evidence:
1.On 06/15/2023 Staff #1 roughly handled Child #1 by grabbing the child by the wrist and pulling the child, causing the child to fall to his knees, and roughly moving the child to being seated on a nearby carpeted area.
2.During an interview with Staff #2, it was acknowledged that Staff #1, ?just had enough? and was observed throwing Child #1?s toy, and then pulling him towards her to sit him down.
