Comments:
An unannounced non-mandated monitoring inspection, in response to a self-reported incident regarding Part VI Programs, was conducted on May 2, 2023 - July 11, 2023. The inspector reviewed compliance in the areas of administration, staff qualifications and training, programs, the license, and the licensing process. A total of 3 child records and 1 staff record were reviewed.

Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.

Please complete the ?plan of correction? and ?date to be corrected? for each violation cited on the violation notice and return it to me within 5 business days from today. Please specify how the deficient practice will be or has been corrected. Your plan of correction should contain: 1) steps to correct the noncompliance with the standard(s), 2) measures to prevent the noncompliance from occurring again; and 3) person(s) responsible for implementing each step and/or monitoring any preventative measures. Please do not use staff names; list staff by positions only.

Standard #: 8VAC20-780-40-E
Description: Repeat Violation
Based on a review of documents and staff and child interviews, the licensee failed to ensure that the center complied with the center?s own discipline policy regarding acceptable and unacceptable discipline measures.
Evidence: 1. Page 1 of the center?s discipline policy titled ?Guidance, Protection of and Respect for Children,? states ?employees must adhere to all applicable state and local laws governing child guidance or discipline. Employees are required to use positive guidance techniques and to refrain from an unacceptable measures while caring for children on behalf of the Company.?
2. On page 1 and continued to page 2 the policy states unacceptable measures include: ?any kind of physical discipline or corporal punishment. Employees may not use physical actions to punish or humiliate children in any way.?
3. On April 14, 2023, there was an incident involving child 1 and staff 2. In an interview with child 1 on May 2, 2023, the child reported that staff 2 ?pushed me out of bed.? Child 1 stated that staff 2 covered her mouth and said ?stop crying.?
4. In an interview with staff 1 on May 2, 2023, it was reported that on April 14, 2023, staff 1 witnessed child 1 fall to the floor and begin crying after staff 2 purposefully put her foot under child 1?s cot and lifted the cot up, causing the child to fall off.

Plan of Correction: 1: Center Management retrained all staff on Positive Child Guidance on February 20, 2023. By July 31, 2023 all pods will sign a recommitment to positive child guidance methods. In August, the QHRBP (Quality Human Resources Business Partner) will facilitate an in-person training on Interactive Positive Child Guidance. Management will continue to use S.E.T (Standards of Excellence in Teaching) resources and tools to provide additional guidance and training for quality ECE programming.
E. CD/AD are responsible for conducting pod meetings to initiate recommitment to Positive Child Guidance (Infants, Toddlers, Twos, Preschool, Pre-Kindergarten, and School Age) ( by 7/31/23)
F. QHRBP responsible for facilitating an Interactive Positive Guidance Training (August 2023)
G. CD/AD are responsible for routine application and implementation of SET (Standards of Excellence in Teaching) on a routine basis.
H. During center visits District Leader will ensure all steps are met. Next visit in August
Center management will ensure that all steps are met.

Description: Repeat Violation
Based on staff and child interviews and a review of records, the center failed to ensure that roughly handling a child was forbidden.
Evidence: 1. In an interview with staff 1 on May 2, 2023, the following was reported: On April 14, 2023, staff 1 witnessed staff 2 take a blanket away from child 1 at naptime, who then began crying; staff 2 then used her foot to lift child 1?s cot up, causing the child to fall onto the floor; Child 1 began hysterically crying and hyperventilating; Staff 2 took child 1?s hand, covered child 1?s mouth with her own hand, and then told child 1 to stop crying, she didn?t want to hear it.
2. In an interview with child 1 on May 2, 2023, the following was reported regarding an incident that occurred April 14, 2023: a) staff 2 ?pushed me out of bed?; b) ?I cried? c) ; staff 2 ?covered my mouth and said stop crying.?
