Comments:
An investigation was initiated on June 21, 2023, and concluded on July 18, 2023 in response to a self-reported allegation received by the department on June 16, 2023 regarding supervision. The inspector conducted an onsite unannounced inspection on June 21, 2023, from approximately 10:10am until 2:30pm. Interviews with staff were completed, observations were made at the center, and documentation was reviewed. Additional interviews were conducted on July 13, 2023. The preponderance of evidence gathered during the investigation does support the self-reported allegation; therefore, the allegation was determined to be valid. Please see violation notice for additional information.

Please complete the ?plan of correction? and ?date to be corrected? for each violation cited on the violation notice and return it to me within 5 business days from the date of receipt. You should specify how the deficient practice will be or has been corrected. Your plan of correction should contain: 1) steps to correct the noncompliance with the stand(s), 2) measures to prevent the noncompliance from occurring again; and 3) person(s) responsible for implementing each step and/or monitoring any preventive measure(s).

Violations:
Standard #: 8VAC20-780-40-E
Description: Based on staff interviews and documentation review, the center failed to ensure that the center?s activities, services, and facilities are maintained in compliance with 1the center?s own policies and procedures that are required by these standards.

Evidence:
1. The written center?s Standard Operating Procedures (SOP) for Child Supervision Record (CSR) states ?When transitioning from one location to another, teachers will use the Name-to-Face Transitions section of the CSR to confirm all children are accounted for during transitions, whether that be a transition within the classroom or across thresholds.
2. On June 15, 2023, at approximately 3:50pm, the center?s fire alarm was activated. Staff and children evacuated the building to playgrounds.
3. Staff #1 and Staff #2 along with eight Toddlers left the classroom through the door leading to the playground.
4. Child #A (20-month-old child) was found alone in the Toddler classroom by the child?s parent.
5. On June 16, 2023, management completed a ?Coaching Form? for Staff #1. The Coaching Form stated the following: ?During fire evauation (sic) a child in your care who is not ambulatory was left in the classroom unattended. Child was retriveed (sic) by her mother who arrived to pick up the child. It was further observed that your CSR was inaccurate. It was found no name to face was complete foloowing (sic) the transition to the play area. You were provided CSR training on several occasions. You werepreviously (sic) coached on 05/17/23 for a child in your care who was left in another classroom where the child was returned by another staff member.?

Standard #: 8VAC20-780-340-A
Description: Based on review of documentation and interview, the center did not always provide care and protection to a child they were supervising.
Evidence:
1. On June 15, 2023, at approximately 3:50pm, it was determined Staff #1 and Staff #2 left Child A (20-month-old child) alone in the Toddler?s classroom for approximately five to 10 minutes.
2. Child #A was found alone in the Toddler classroom by the child?s parent.
3. According to Collateral Contact, the child?s parent arrived at the school around 4:00pm and saw everyone outside and the fire alarm was going off. I did not see [Child A] with her class. The teachers were sitting in the shade on the playground and clearly had a chance to get settled. I went into the classroom and found [Child A] sitting at the table eating an apple slice. [Child A] does not walk and is not ambulatory. [Child A] was the only person in the classroom.?

Standard #: 8VAC20-780-340-F
Description: Based on review of documentation and interview, the center did not ensure children under 10 years of age were always within actual sight and sound supervision of staff.

Evidence:
1. Staff #1 and Staff #2 stated they were supervising 9 children in the Toddler classroom on June 15, 2023. A little before 4:00pm the fire alarm went off. Staff #1 and Staff #2 said they took the Toddlers outside to the playground to line up by the fence. Staff #1 stated she thought she had all the children but realized Child #A was not outside with them. Staff #1 and Staff #2 stated the parent of Child #A came out the door and said, ?Did you realize you left her inside?.
3. The parent of Child #A stated she went into the Toddler?s classroom and found Child #A sitting alone in the classroom with all the doors closed. No one else was in the classroom with Child A.
