Comments:
An unannounced monitoring inspection was conducted on 08/07/2023. There were 25 children, ages 23 months- 7 years, and 7 staff members providing direct care and supervision present during the inspection. The inspector reviewed compliance in the areas of administration, staff qualifications and trainings, staffing and supervision, physical plant, programs, emergencies and nutrition. The children were observed during arrival, mealtime, teacher directed activities, and self-directed activities. A total of 5 children?s records, and 5 staff records were reviewed. The inspector discussed the following with the provider: sanitizing. The inspector arrived for the inspection at 8:00 am and departed at 10:15m.

The information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice to the provider.

Violations:
Standard #: 8VAC20-780-140-A
Description: REPEAT VIOLATION
Based on record review and interview with staff, the center failed to obtain documentation that each child shall have a physical examination by or under the direction of a physician before the child?s attendance or within 30 days after the first day of attendance.

Evidence: The record for Child 3 contained a documented start date of 03/02/2022. There was not documentation of a physical examination in the record for Child 3. Staff 6 confirmed the documentation of a physical examination was not available for review.

Plan of Correction: Provider will obtain information from parents.

Standard #: 8VAC20-780-70
Description: REPEAT VIOLATION
Based on record review and interviews with staff, the center failed to ensure that staff records contain all of the elements as required by the standards.

Evidence:
1. The record for Staff 1 documented a hire date of 03/01/2023. The record for Staff 1 did not contain the following: documentation that two or more references as to character and reputation as well as competency were checked before employment. Staff 6 confirmed this information was not available.
2. The record for Staff 2 documented a hire date of 02/28/2023. The record for Staff 2 did not contain the following: documentation that two or more references as to character and reputation as well as competency were checked before employment. Staff 6 confirmed this information was not available.
3. The record for Staff 3 documented a hire date of 06/13/2023. The record for Staff 3 did not contain the following: documentation that two or more references as to character and reputation as well as competency were checked before employment. Staff 6 confirmed this information was not available.
4. The record for Staff 4 documented a hire date of 07/25/2022. The record for Staff 4 did not contain the following: documentation that two or more references as to character and reputation as well as competency were checked before employment. Staff 6 confirmed this information was not available.

Plan of Correction: Provider will obtain the required information before hire.

Standard #: 8VAC20-780-80-A
Description: Based on observation and interviews with staff, the center failed to ensure that for each group of children, the center shall maintain a written record of daily attendance that documents the arrival and departure of each child in care as it occurs.

Evidence: As of approximately 8:05 am on 08/07/2023, the daily attendance for the group of children in care had not been taken. Staff 1 stated that they usually take attendance later in the morning after the majority of the children arrive. There was a total of 12 children in care. The daily attendance record did not document the arrival of each child as it occurred.

Plan of Correction: Staff will take attendance at the time of arrival and departure.

Standard #: 8VAC20-780-280-B
Description: Based on observations the center failed to ensure that hazardous substances such as cleaning materials, insecticides and pesticides shall be kept in a locked place using a safe locking method that prevents access by children.

Evidence:
A chemical dispensing system, containing 3 Cintas liquid cleaning materials (Hard Surface Sanitizer, Glass and Multi Surface Cleaner and Neutral Floor Cleaner), was attached to the wall in the downstairs children?s restroom. Chemicals dispensed from a hose when a button is pushed. Children were observed using this restroom during the inspection.

Plan of Correction: Provider will consult a contractor to build a locking container or have CINTAS move dispenser.

Standard #: 8VAC20-780-500-A
Description: Based on observations, the center failed to ensure that children?s hands shall be washed with soap and running water or disposable wipes before and after eating meals or snacks.

Evidence: Children were observed returning to activities without washing their hands or using a disposable wipe after eating breakfast.

Plan of Correction: Staff will follow handwashing standards.

Standard #: 8VAC20-780-560-F
Description: Based on observation, the center failed to ensure that when a center chooses to provide meals or snacks, the center shall follow the most recent, age-appropriate nutritional requirements of a recognized authority such as the Child and Adult Care Food Program of the United Stated Department of Agriculture.

Evidence: The USDA requires that a serving from all three components (fluid milk, vegetables/fruits or portions of both and grains) must be served for breakfast. The children were served the following for breakfast: cereal and milk. The children were not served vegetables/fruits or portions of both with breakfast.

Plan of Correction: Staff will serve the appropriate food components.
