Comments:
A complaint investigation was conducted on July 19, 2023, and July 24, 2023, after a complaint was received in our office regarding supervision, injury reports, staff qualifications and background searches. Based on multiple staff interviews, a review of documentation and staff record review, the preponderance of evidence supports the allegations and the complaint is deemed valid. During the investigation an issue was discussed with management about staff seeming to be unaware the Licensing Inspector (LI) had entered a room and walked through the room behind them. The Regional Manager stated they also observed the staff person on their phone moments later, when LI asked them to observe the room.
On May 8, 2023, VDOE responded to a letter from Guidepost Montessori received on 4/13/23, stating their policy of moving children at 2.5 years into Balanced Mixed Age (BMA) group rooms. VDOE stated: The standards define balanced mixed-age grouping as ?a program using a curriculum designed to meet the needs and interests of children in the group and is planned for children who enter the program at three through five years of age. The definition of balanced-mixed-age grouping does not afford flexibility to allow children younger than three years of age.

Evidence:
Staff #2 and # 3 did not have documentation of the results of a nationwide fingerprint search available for review. Staff had been at the facility for a week as substitutes.

Description: Based on multiple staff statements, while supervising children, staff did not ensure, protection and guidance.
Evidence:
On 7/12/23 Child A was trapped by their leg in a piece of playground equipment. Staff were not able to intervene or explain how the incident occurred. The child did have a bruised leg from being stuck between the slats of the bridge portion of the equipment.

Based on staff statements, children under 10 years of age were not always within actual sight and sound supervision of staff.
Evidence:
*On 5/19/23 Child A exited the building into the parking lot. Staff were not aware that the child had left the building. The child was found simultaneously by their parents between approximately 5:00-5:30PM.
Staff confirmed the incident occurred.
*On 7/19/23 Staff #2 was observed in a classroom with 3 children that were doing individual activities. The staff person was observed ?scrolling? through their phone, not actively supervising children.

Description: Based on a review of classroom attendance sheets and observation, children that were 2 years old were combined with children aged 3-5 years old without maintaining a 1:8 (Staff to child) ratio.
Evidence:
*8 children under the age of 3 were moved to the Children?s House rooms 1 and 2, that use a Balanced Mixed Age group ratio of 1:14. Two staff were assigned to each of the Children?s House rooms.

*On 7/19/23 both Children?s House I and 2 rooms were observed together on the playground. During the inspection, there were 42 children with 5 staff on the playground. The group contained 3 children that were not yet 3 years old. A 1:8 ratio was not maintained.

Description: Based on staff statements, and a review of injury reports, the center did not maintain record of children?s injuries.
Evidence:
On 7/12/23 Child A was stuck between the slats of a piece of playground equipment. The child was given ice to put on her leg. The child?s leg was bruised. No injury report was provided to the parents that day. Parents were made aware of the circumstances of the incident/injury the following morning by a staff member.
