Comments:
An unannounced monitoring inspection conducted on August 24, 2023 between the hours of 11:30am and 2:00pm. There was a total of 37 children with 7 staff members supervising. Children were observed engaged in group activities, playing with various age-appropriate toys, riding trikes, playground activities, painting, reading, eating lunch, handwashing, and nap-time. The inspector reviewed compliance in the areas of administration, physical plant, staffing and supervision, programming, medication, children and staff records, special care and emergencies and nutrition. The information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the facility.

Violations:
Standard #: 8VAC20-770-60-C-2
Description: Based on record review and interview, the licensed child day program did not have a central registry finding within the 30 days of employment.
Evidence:
1. The record for Staff #4 (DOH 6/28/23) did not contain a Virginia Central Registry finding.
2. The director confirmed that Staff #4 did not have a Central Registry finding in their record.

Plan of Correction: The request was submitted but I never received any results. I will resubmit today and follow up if it's not back within 30 days.

Standard #: 8VAC20-780-140-A
Description: Based on record review, each child did not have a physical examination by or under the direction of a physician within 30 days after the first day of attendance.
Evidence:
1. The record for Child #3 (date of enrollment 06/26/23) did not have documentation of a physical examination by a physician within 30 days after the first day of attendance.

Plan of Correction: I will require physicals are provided within 30 days for all new enrollments.

Standard #: 8VAC20-780-70
Description: Based on record review, staff records did not have documentation that two or more references as to character and reputation as well as competency were checked before employment.
Evidence: The records for Staff #4 (DOH 6/28/23) did not have documentation of two (2) or more references before employment.
2. The Director acknowledged there was only one (1) reference check for Staff #4.

Plan of Correction: I will obtain 2 references going forward on all new employees.

Standard #: 8VAC20-780-510-E
Description: Based on review of medications and authorizations, the center's procedures did not meet requirements to administer medication.
Evidence:
Child #4 had an emergency allergy medication on site but did not have the physician's authorization as required for long-term prescriptions.

Plan of Correction: I will notify the parent today that they must have a physician's authorization for the long-term medication.

Standard #: 8VAC20-780-510-P
Description: Based on review of the medication being stored at the center, it was determined that the licensee did not ensure that when an authorization expires, the parent shall be notified that the medication needs to be picked up within 14 days or the parent must renew the authorization.
Evidence: The medication authorization for child #5 was expired (expired November 2022), but the medication was still at the center.

Plan of Correction: I will notify the parents today that they must pick up the medication or bring in a authorization form.
