Comments:
An unannounced complaint investigation was conducted on 08/28/2023 regarding allegations of that a staff person roughly handled children. The Center's video recordings were observed, staff Interviews were conducted, and records were reviewed in response to the allegations.

The evidence gathered during the investigation did support non-compliance with standards or law.

Description: Based on video observation and staff interview, staff did not ensure the care, protection and guidance of a child.

Evidence:

1. On 08/17/2023 at approximately 10:43am, the video shows Child #1(15 months old) joining Staff #1 and Staff #2 on the carpet for circle time after a diaper change. Staff #1 puts Child #1 on their lap. Child #1 is crying and pulling away from Staff #1 to return to Staff #3 that is across the room at the diaper changing station. Child #1 continues to cry and pulls away from Staff #1 by getting up from their lap. Staff #1 grabs Child #1's left arm and pulls Child #1 towards them in a jerking motion to keep Child #1 sitting near them. Child #1 rolls and kicks on the carpet to release themselves from Staff #1. Staff #1 grabbed Child #1's right upper arm, jerks the child towards them roughly and forcibly placed Child #1 down in a seated position a total of ten times for a duration of approximately six minutes minutes.
2. Staff #2 is observed on the video on the carpet while Staff #1 roughly handles Child #1. Staff #2 continues to supervise the other children on the carpet without attempting to comfort Child #1.
3. Staff #2 stated that Staff #1 was "frustrated that day with the crying and transition of Child #1. Staff #2 stated "I told [Staff #1] to let [Child #1] go."
4. After approximately six minutes, Staff #1 releases Child #1 from their grasp.

Plan of Correction: All staff will complete a training on 08/31/2023 going over handling children with love and care, state of emotions, advocating for children, and reporting signs of child abuse and neglect and mandated reporting procedures.

Evidence:
Video recordings of the Toddler classroom on 08/17/2023 captured an incident of Staff #1 roughly handling a child in care.
1. At approximately 10:43am, Child #1(15 months old) joins Staff #1 and Staff #2 on the carpet for circle time after a diaper change. Staff #1 puts Child #1 on their lap. Child #1 is crying and pulling away from Staff #1 to return to Staff #3 that is across the room at the diaper changing station. Plan of Correction: Staff #1 was terminated from the company after the incident was reported. All staff will complete a training on 08/31/2023 going over handling children with love and care, state of emotions, advocating for children, and reporting signs of child abuse and neglect.
