Technical Assistance:
Technical assistance given and licensing standards were reviewed regarding the use of fans, TB tests, expired medication, and auditing files.

Comments:
An unannounced renewal inspection was completed August 28, 2023. Inspector arrived at 9:30am and departed at approximately 12:40pm. There were 53 children and 12 staff members present. The Inspector observed five children?s records and five staff records. The Inspector observed staff and children?s interactions throughout the inspection. Children were observed during indoor play, group activity, handwriting, lunch, handwashing, bottle feeding, and transition to nap. Emergency preparedness documents were observed. Medications are administered at the center and were observed. Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented. The violations are listed on the violation notice issued to the center and were reviewed with the Director at the exit interview.

Violations:
Standard #: 22.1-289.035-A
Description: Based on record review and interview, it was determined that the center failed to acknowledge that the background checks in the staff record show a disqualifying background which lists a barrier conviction, other felony conviction in the past 5 years, or knowledge of barrier for Virginia or elsewhere.
Evidence:
1. Staff #5 (date of hire 4/03/2023) completed the background check for the State of Virginia and the documentation dated 4/12/2023, disqualifies the staff member to work in a daycare setting stating, ?Not Eligible.?
2. The center failed to acknowledge that the background check for Staff #5 dated April 12, 2023, disqualified them as the document states, ?Not Eligible.?
3. Staff #1 confirmed that the background check for the State of Virginia dated April 12, 2023, for Staff #5 disqualifies them from working in the center.

Plan of Correction: The center responded with the following: Staff #5 was terminated on 8/28/2023.

Standard #: 22.1-289.035-B-2
Description: Based on record review and interview, it was determined that the center did not ensure that the criminal history records check is received prior to the first day or employment.
Evidence:
1. Staff #4 (date of hire 08/15/2023) was present at the center working with children and had a background check for Virginia dated on 8/22/2023, which is after the first day of employment.
2. Staff #1 confirmed that Staff #2 was a new hire and has been around children in the center starting the hire date of 08/15/2023.

Plan of Correction: The center responded with the following: The center will obtain the criminal history records for Staff #4 and send the results of the checks to the licensing inspector.

Standard #: 22.1-289.035-B-4
Description: Based on record review and interview, it was determined that the center did not ensure that they obtain a copy of the results of a criminal history record information check, a sex offender registry check, and a search of the child abuse and neglect registry or equivalent registry from any state in which the individual has resided in the preceding five years.
Evidence:
1. Staff #4 (date of hire 8/15/2023) reported on their Sworn Statement Disclosure dated 08/15/2023, that they lived in another state outside of Virginia in the past five years.
2. Staff #1 confirmed that the out of state background check was not completed for Staff #2.

Plan of Correction: The center responded with the following: The out of state checks will be completed, reviewed, placed in the staff member's file, and sent to the licensing inspector.

Standard #: 8VAC20-770-60-C-2
Description: Based on record review and interview, it was determined that the center did not ensure that central registry results by the end of the 30th day of employment was completed.
Evidence:
1. Staff #5 (date of hire 4/03/2023) did not have their results for the Virginia Central registry which is required by the end of the 30th day of employment.
2. Staff #3 (date of hire 5/04/2023) did not have their results for the Virginia Central registry which is required by the end of the 30th day of employment.
3. Staff #1, the director, confirmed that there the Virginia Central Registry results for both Staff #5 and Staff #3 were not completed by the end of the 30th day of employment.

Plan of Correction: The center responded with the following: The Virginia Central registry checks will be completed and the results will be placed in the staff members record.

Standard #: 8VAC20-780-270-A
Description: Based on observation and interview, it was determined that the center did not ensure that areas and equipment of the center be maintained in a safe and operable condition.
Evidence:
1. The entrance hallway and 2 year old classroom has loose baseboards in reach of children in care. This poses as injury and/or tripping hazard.
2. The doors to the 2 year old classroom and infant room have chipping paint in reach of children.
3. Staff #1 confirmed that there are loose baseboards and chipping paint in reach of children in care.

Plan of Correction: The center responded with the following: A work order will be placed for the repairs of the baseboard and repainting of the wall and door.

Standard #: 8VAC20-780-280-B
Description: Based on observation and interview, it was determined that the center did not ensure that hazardous substances such as cleaning materials be kept in a locked place using a safe locking method that prevents access by children.
Evidence:
1. In the children?s bathroom, there was disinfectant cleaner with a warning label, ?Keep out of reach of children? in a cabinet and not locked.
2. In the toddler classroom, there were two bottles of disinfectant cleaner unlocked in a cabinet with warning labels that state, ?Keep out of reach of children.?
3. Staff #1 confirmed that both the children?s bathroom and toddler classroom had disinfectant cleaners that were unlocked.

Plan of Correction: The center responded with the following: The center immediately locked the hazardous substances during the time of the inspection.

Standard #: 8VAC20-780-290-A-3
Description: Based on observation and interview, it was determined that the center did not ensure that for general physical plant requirements for centers serving children of preschool age or younger in areas used by children of preschool age or younger, electrical outlets shall have protective covers that are of a size that cannot be swallowed by children.
Evidence:
1. In the 2 and 3 year old classrooms and the children?s bathroom, there were electrical outlet cover that did not have a protective cover in reach of children.
2. Staff #1 confirmed that the electrical outlet in the 2 and 3 year old classrooms and the children?s bathroom were not covered.

Plan of Correction: The center responded with the following: Outlet covers were placed during the time of the inspection.

Standard #: 8VAC20-780-440-G
Description: Based on observation and interview, it was determined that the center did not ensure that cribs shall be used for children under 12 months of age and for children over 12 months of age who are not developmentally ready to sleep on a cot or mat.
Evidence:
1. Three of the twelve children in the infant room are the age of 12 months and older and are sleeping in a crib.
2. The infant staff members confirmed that the three children that are 12 months of age or older are sleeping in cribs and not cots or rest mats.
3. Staff #1, the Director, confirmed that all the children in the infant room that are above the age of 12 months of age are sleeping in cribs.

Plan of Correction: The center responded with the following: The children that are 12 months or above in the infant room will transition from the crib to a cot. Parent will also be notified that the children will now be sleeping on a cot.
