A complaint inspection was conducted on 8/29/2023. The inspector arrived at 12:35 PM and departed at 3:08 PM. The investigation included interviews, observation and review of documentation. The inspector reviewed compliance in the areas of administration and staffing and supervision.
The complainant alleged inadequate supervision of the infants and use of inappropriate discipline techniques. A preponderance of evidence collected did not support these allegations.
Also alleged was inadequate staffing to meet required staff/child ratios. Information gathered during the investigation determined non-compliance with an applicable standard and a violation was documented on the violation notice issued to the program and discussed with the program director during the exit interview.

Standard #: 8VAC20-780-350-B-1 Complaint related: Yes Description: Based upon staff interview, the facility has not ensured that there is one staff person for every four infants in care.
Evidence:
1. Staff interviews and review of attendance records revealed that on April 24, 2023 infants arrived into care earlier than the usual times resulting in more than four infants with one caregiver for approximately fifteen minutes until a second staff person came on duty in the classroom.
2. Staff interviews revealed that occasionally there can be one or two infants over the required 4 children per caregiver until additional coverage can be arranged.Plan of Correction: The provider responded with the following:
Administration does not agree with the interview results of 15 minutes before ratio coverage is provided. If a room goes over ratio, at any time, a member of the admin team steps in the room until coverage can be solved. Unfortunately, the tracking app we use does not show staff in the room that are not ?assigned? to that particular room. For instance, if the Director or Floater steps in to the Toddler room and checks into the app, since they are designated ?admin? or ?Floater? and not ?toddler teacher?, they are shown as in the classroom in real-time for ratio purposes, but when a report is generated at a later date, it does not show in the report done for a past date. This is why the report generated at the time of the investigation did not show an accurate account of ratio in the room and time in question. We have brought this to the attention of the IT support team for the app. In the meantime, to be extra cautious, we are now adding additional staff when a classroom is 1 below ratio to ensure extra coverage early.
