Comments:
A complaint was received in the licensing office on 9/20/2023 regarding behavioral guidance concerns. On 9/26/2023 an on-site investigation was conducted with another local agency. Interviews were conducted and observations were made. After carefully reviewing the preponderance of evidence, the complaint is deemed valid. Areas of non-compliance are identified on the Violation Notice.

Standard #: 8VAC20-780-40-E
Complaint related: No
Description: Based on interview and a review of the programs policies, the licensee failed to ensure that the center's activities, services are maintained in compliance with these standards, the center's own policies and procedures that are required by these standards.
Evidence:
1. The centers positive discipline and behavioral management policy states ?The use of corporal punishment or inappropriate, negative behavior management interventions by staff?are strictly prohibited.? The center uses non-restrictive procedures that ?utilizes non-aversive practices including relationship building, respectful teaching, modeling...? The policies also state that ?the use of aversive stimuli is prohibited?.
2. Staff #1 signed that they had been trained on the center?s policies and procedures on 6/8/2004.
3. On 9/18/2023, the parent of Child #1 observed Staff #1 splash a cup of water in Child #1?s face after the child got up and walked away from a group of children and staff on the playground.
4. Staff #1?s response to Child #1 walking away from the group did not teach respect or encourage relationship building.

Description: Based on interviews, staff did not interact with children to provide comfort and support in order to promote children?s physical, intellectual, emotional, and social well-being.
Evidence:
1. On 9/18/2023, the parent of Child #1 approached the outdoor playground at pick-up time. The child saw their parent, got up from the group and began walking towards their parent. The staff on the playground had their backs to the gate door and did not see the parent approach from behind. The parent of child #1 observed staff #1 splash a cup of water in child #1?s face after the child got up and walked away from a group and towards their parent.
2. Photograph #1 (taken at the facility) shows water splashed on child #1?s face and water marks on the front of the child?s shirt.
3. Staff #1?s response to child #1 walking away from the group did not provide comfort and did not promote the child?s physical, intellectual, emotional, and social well-being.
