Comments:
An unannounced renewal inspection was conducted on October 4, 2023 between the hours of 9:15am-12:00pm. There were a total of 45 children with nine supervising staff members present. The inspector reviewed five children's records and five staff records. Children were observed during centers, a buggy walk, engaged in group activities and outdoor play time. Areas of non-compliance are identified in the violation notice. Repeat violations were found and identified within this report.

Please complete the "plan of correction" and "date to be corrected" for each violation cited on the violation notice and return it to the department within 5 business days from receipt. Please specify how the deficient practice will be or has been corrected.

Any plans of correction not received within 5 business days will result in the plans not appearing on the Violation Notice and public website.

Violations:
Standard #: 22.1-289.035-B-4
Description: Based on record review, the center did not obtain a copy of the results of a criminal history record information check prior to the first day of employment for an individual that has resided out of state in the preceding five years.
Evidence:
1. Staff #1's record (Date of hire-08/14/2023) contained documentation of a Sworn Disclosure Statement that Staff #1 has lived in the state of Texas in the preceding five years. There was no documentation of an out of state criminal background check results in the record.

Plan of Correction: An out of state criminal background check for the state of Texas for the employee was submitted.

Standard #: 8VAC20-780-270-A
Description: Repeat Violation
Based on observation, areas and equipment of the center, inside and outside, were not maintained in a clean, safe and operable condition.
Evidence:
1. In the toddler classroom, a plastic edge protector on the wall located near the door was cracked and exposed sharp edged that could entangle clothing and snag skin.
2. In the Early Preschool Classroom, there was peeling paint located on the door leading to the Two year old classroom.
3. In the two year old classroom, the peddle to the peddle operated trashcan was not operational.
4. On the Toddler Playground, there is cracked and splintering wood from top to bottom of one pole of the house figure and deteriorating wood located on the top of the musical instrument. The cracked, deteriorating and splintering wood exposes sharp edges that can entangle clothing and snag skin.
5. On the Big Playground, a wooden floor board on the gazebo is loose and protruding causing a tripping hazard. The wooden steps of the gazebo had deteriorating wood that exposed a nail head.

Plan of Correction: The trashcan was replaced in the two year old room and work orders have been placed to correct the peeling paint, the edge protector, deteriorating wood on the playgrounds.

Standard #: 8VAC20-780-330-B
Description: Based on observation of the playground, the minimum of 6 inches of resilient surface material(mulch) was not present under the climber on the large playground.
Evidence:
1. The mulch located at the bottom of the fall zones on the playground was not maintained in such a manner that it complies with the minimum safety standards of the depth of six inches. The dirt on the ground was exposed.

Plan of Correction: A work order has been placed to get a shipment of mulch for the playground.
