Conducted an unannounced complaint investigation at 7:17am. Observations made, staff interviewed and records reviewed. Based on the evidence collected this complaint has been deemed to be valid. Based on records reviewed, 2 of 2 staff records did not include documentation of completed background checks in the past 5 years.

Evidence:

1. The employment record for Staff #7did not include a current criminal record check or central registry search. The previous criminal record check was dated as completed 5/17/18, and the previous central registry search was dated as completed 7/10/18.
2. The employment record for Staff #8 did not include a current criminal record check. The previous criminal record check was dated as completed 3/8/18.

Description: Based on observations made and interviews conducted, Staff #4 did not ensure that medication administered to Child #5 was done so in accordance with the center's medication policies.

Evidence:

1. Staff #4 was observed by the inspector taking a pill from what appeared to be a personal bag stored in a classroom cabinet and giving it to Child #5.
2. When asked, Staff #4 told the inspector that she gave Child #5 a "Tylenol" pill.
3. The center's policy for medication administration policy does not include over-the-counter medications.
4. There was no written medication authorization for center staff to administer medication to Child #5.

Description: Based on observations made, records reviewed and staff interviewed, staff failed to maintain a written record of daily attendance that documented the arrival of each child in care as it occurred on 9/27/23.

Evidence:

1. At 7:23am, the inspector observed 2 staff with 12 preschool-age children in the Preschool-1 classroom. The written attendance records for the classes that arrive to this room in the early morning hours (before individual classrooms are opened for Preschool-1, Preschool-2, PreK-1, and PreK-2 classes) indicated there were 2 children present at that time.
2. At 7:36am, the inspector observed 2 staff with 14 preschool-age children in the Preschool-1 classroom. The written attendance records for the classes that arrive to this room in the early morning hours (before individual classrooms are opened for Preschool-1, Preschool-2, PreK-1, and PreK-2 classes) indicated there were 2 children present at that time.
3. At 7:38am, the inspector observed 2 staff with 15 preschool-age children in Room 6. The written attendance records for the classes that arrive to the Preschool-1 classroom in the early morning hours (before individual classrooms are opened for Preschool-1, Preschool-2, PreK-1, and PreK-2 classes) indicated there were 2 children present at that time.

Evidence:

1. On 9/21/23, an exterior building door was found open by parents. [See photo #1]
2. When interviewed, staff reported finding an exterior building door propped open on 9/26/23.

Description: Based on observations made, staff failed to ensure that a child under the age of 10 years old was maintained in sight and sound supervision of staff.

Evidence:

1. At 7:51am, the inspector observed a 4 year-old child (Child #5) being told to go to a classroom located next to the one they were in. Child #5 followed the instructions and left their assigned classroom, went into the hallway and then entered the adjacent classroom.
No staff from either room were in the hallway and the child was not in sight supervision.
2. Seconds later, Child #5 left the adjacent classroom, entered the hallway and returned to the assigned classroom. No staff from either room were in the hallway and the child was not in sight supervision.
3. At 7:52am, Child #5 left the assigned classroom for a 2nd time, entered the hallway and then the adjacent classroom. No staff from either room were in the hallway and the child was not in sight supervision.
4. The distance between the classroom doors was approximately 12-15' and there were many other children and parents in the hallway at the time.

Based on observations made, 1:10 staff-to-child ratios were not maintained in one classroom on 9/27/23 for a period of minutes.

Evidence:

1. At 7:51am, the inspector observed 1 staff person with 13 children in the PreK-2 classroom.
2. At 7:54am, the inspector observed a 2nd staff person arrive to the PreK-2 classroom.

Description: Repeat violation.
Based on observations made and interview conducted, staff temporarily assigned a child to a different age class in an effort to maintain ratios on 9/27/23.

Evidence:

1. A 4 year-old child was moved to a 3 year-old class for approximately 4 minutes.
2. Staff told the inspector the reason the child was moved to another class was because of ratios.
