Comments:
An unannounced monitoring inspection was conducted on 10/16/2023 from 9:54 am-11:55 am. There were 39 children supervised by 4 direct care staff. The physical plant, 5 staff records, 5 children?s records, medications, evacuation drills, and policies were inspected. Children were observed participating in tabletop activities and circle time. Areas of non-compliance are identified in the Violation Notice. Thank you for your cooperation during this inspection. Standard #: 22.1-289.035-B-2
Description: REPEAT VIOLATION

Based on record review and staff interview, 3 of 5 staff files indicated that the center failed to obtain a Criminal History Records Check Prior to 1st Day of Employment.

Evidence:
1. The record of Staff #1 (hired 08/16/2023) criminal history check is dated 08/28/2023.
2. The record of Staff #2 (hired 07/05/2023) criminal history check is dated 08/10/2023.
3. The record of Staff #4 (hired 08/16/2023) criminal history check is dated 08/18/2023.

Plan of Correction: Moving forward, we will make certain that all St. Bernadette Catholic School employees, who work in programs overseen by the Virginia Department of Social Services (i.e. preschool), will have a criminal history check completed prior to their first day of employment. The hiring process will be reviewed to ensure this is completed at the appropriate time.
Please note: Staff #4 received an offer letter 8/16/23. The criminal background check for this employee is dated 8/18/23. This employee did not begin working until 8/28/23.

Description: REPEAT VIOLATION

Based on record review and staff interview, 1 of 5 staff files indicated that the center failed to obtain an out-of-state child abuse and neglect search request by the end of 30th day of employment.

Evidence: There was no documentation of an out-of-state central registry check for Staff #4 hired on 08/16/2023.

Plan of Correction: A form was emailed by one of our licensing representatives during the visit to our center. At the end of the day this was shared with the staff member to complete. This form will be submitted as soon as possible so that this violation is corrected.

Description: REPEAT VIOLATION

Based on record review and staff interview, 4 of 5 staff files indicated that the center failed to obtain a sworn statement prior to 1st day of employment.

Evidence:
1. The record of Staff #1 (hired 08/16/2023) sworn statement is dated 9/11/2023.
2. The record of Staff #2 (hired 07/05/2023) sworn statement is dated 8/24/2023.
3. The record of Staff #3 (hired 08/16/2023) sworn statement is dated 8/26/2023.
4. The record of Staff #4 (hired 08/16/2023) sworn statement is dated 9/11/2023.

Plan of Correction: Moving forward, we will make certain that all St. Bernadette Catholic School employees, who work in programs overseen by the Virginia Department of Social Services (i.e. preschool), will have a sworn statement on file prior to their first day of employment. This form will be included in the new-hire paperwork for those employees working within these programs.

Standard #: 8VAC20-780-160-A
Description: Based on record review and staff interview, 3 of 5 staff files indicated that the facility failed to obtain documentation of a negative tuberculosis screening (TB) at the time of employment and documentation that a tuberculosis screening (TB) had been completed within the last 30 calendar days of the date of employment.

Evidence:
1. The TB test documentation on file for Staff #1 was dated 09/3/2023. The start date for Staff #1 is listed as 08/16/2023.
2. The TB test documentation on file for Staff #2 was dated 07/21/2023. The start date for Staff #2 is listed as 07/05/2023.
3. The TB test documentation on file for Staff #4 was dated 08/24/2023. The start date for Staff #4 is listed as 08/16/2023.

Plan of Correction: Moving forward, we will make certain that all St. Bernadette Catholic School employees, who work in programs overseen by the Virginia Department of Social Services (i.e. preschool), will have documentation noting a negative TB screening at the time of employment and documentation noting that the screening has been completed within 30 days prior to employment.
Please note Staff #4 received an offer letter on 8/16/23. This employee provided TB results dated 8/24/23. This employee did not begin work until 8/28/23.

Standard #: 8VAC20-780-40-M
Description: Based on observation and staff interviews, the center did not maintain a current written list of all children's allergies, sensitivities, and dietary restrictions confidential.

Evidence:
1. In the Pre-K A classroom, the allergy list was not kept confidential.
2. The allergy list was posted on the outside of a cabinet door in the classroom.

Plan of Correction: This violation was corrected during the visit. The allergy list was moved from the outside of a cabinet door to the inside of a locked cabinet door, to which only classroom teachers have a key.

Standard #: 8VAC20-780-70
Description: REPEAT VIOLATION

Based on record review and staff interview, 4 of 5 staff files indicated that the center failed to ensure all staff records had all the required documentation.

Evidence: There was no documentation of orientation for Staff #1, Staff #2, Staff #3, and Staff #4.

Plan of Correction: We will print the suggested form from Child Care Virginia and review it with all staff members to ensure that all staff members have received the appropriate training and orientation for working within programs that fall under the guidance of the Virginia Department of Social Services. The form will mark when training took place during orientation week, and employees will sign and date the forms as required.

Standard #: 8VAC20-780-210-A-4-b
Description: Based on record review and staff interview, 2 of 5 staff files indicated that the center did not obtain documentation that all program leaders were qualified.

Evidence: There was no verification of program leader qualification for Staff #3 (DOH: 8/16/2022) and Staff #5 (DOH: 8/16/2023).

Plan of Correction: We will obtain the necessary documentation to verify that the employees in question fulfill the requirements set by the VDSS to be a lead teacher and/or program director. If needed, training and course work will be provided to these staff members to ensure they obtain and meet the minimum requirements for their respective positions.

Standard #: 8VAC20-780-280-B
Description: Based on observation and staff interviews, hazardous substances such as cleaning materials, insecticides, and pesticides were not kept in a locked place using a safe locking method that prevents access by children.

Evidence: In the Pre-K A classroom, disinfectant spray, Clorox, and aromatic absorbent were kept in an unlocked cabinet.

Plan of Correction: There is a working lock on the cabinet in question. Employees will be instructed and reminded to keep all cabinets containing hazardous substances locked to ensure that children have no access to these substances. Child care standards pertaining to cleaning products will be reviewed with classroom teachers and staff members.

Standard #: 8VAC20-780-550-G
Description: REPEAT VIOLATION

Based on record review and staff interview, documentation of emergency evacuation drills were not maintained.

Evidence: There was no documentation of emergency evacuation drills in February, March, April, May, or June of 2023.

Plan of Correction: Using the suggested form linked on the website ?Child Care Virginia?, we will keep detailed records of all emergency drills for the school/calendar year. We will list dates and times of drills, number of students and staff participating, conditions or obstacles, as well as type of drill.
