Comments:
An unannounced monitoring inspection was conducted on 10/12/2023 and concluded with an electronic record review on 10/20/2023. There were 35 children, ages 3 years- 4 years, and 6 staff members providing direct care and supervision present during the inspection. The inspector reviewed compliance in the areas of administration, staff qualifications and trainings, physical plant, staffing and supervision, programs, emergencies, and nutrition. The children were observed during teacher directed activities, self-directed activities, outdoor time and mealtime. The inspector discussed the following with provider: medication. A total of 5 children?s records, 5 staff records and 1 medication were reviewed. The inspector arrived for the inspection at 9:45 am and departed at 12:00 pm.

The information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the provider.

Violations:
Standard #: 8VAC20-780-270-A
Description: Based on observation, the center failed to ensure that areas and equipment of the center, inside and outside, shall be maintained in a clean, safe and operable condition.

Evidence: One of the bottom doors on a storage cabinet located next to the entrance in Class 10 had a broken hinge. The door was hanging off and loose screws were exposed. Children were observed in this area during the inspection.

Plan of Correction: Cabinet will be removed.

Standard #: 8VAC20-780-280-B
Description: Based on observations, the center failed to ensure that hazardous substances such as cleaning materials, insecticides and pesticides shall be kept in a locked place using a safe locking method that prevents access by children.

Evidence: There were 4 containers of Clorox wipes and 1 spray bottle of glass cleaner located in an unlocked storage cabinet located next to the entrance in Class 10 accessible to children. Children were observed in this area.

Plan of Correction: Hazardous substances were removed and locked during the inspection.

Standard #: 8VAC20-780-330-B
Description: Based on observation, the center failed to ensure that where playground equipment is provided, resilient surfacing shall comply with minimum safety standards and shall be under equipment with moving parts or climbing apparatus to create a fall zone free of hazardous obstacles.

Evidence:
1. The height of the slide on the play equipment measured approximately 2 feet 9 inches, which requires a 6 feet 9 inch fall zone for the slide trajectory. The fall zone trajectory measured approximately 4 feet 7 inches.
2. The height of the swings on the play equipment measured approximately 5 feet 4 inches, which requires a 10 feet 8 inch fall zone in the front and back of swing. The fall zone in front of swings measured approximately 10 feet.
3. The fall zone on the left side of play equipment (the slide side) measured approximately 4 feet 7 inches. Six feet of fall zone is required.
4. The fall zone on the right side of play equipment (swing side) measured approximately 4 feet 5 inches. Six feet of fall zone is required.
5. The resilient surfacing (mulch) under the play equipment measured approximately 1 inch under the swings. Ground and grass were visible in multiple areas of the fall zone. Six inches of resilient surfacing is required in the fall zones.

Plan of Correction: Admin staff will be made aware and children will not be allowed to use equipment until proper surfacing is applied .
