Comments:
An unannounced complaint investigation was initiated on 9/22/2023 and was concluded on 10/20/2023 in response to a complaint received by the licensing office on 9/22/2023 regarding supervision and injury reporting. Telephone and email correspondence was exchanged with parent on 9/22, 9/27, and 10/20. Staff interviews and record reviews were conducted relating to the allegations on 9//26/23, 10/5/23, and 10/12/23. The information gathered during the investigation does support the allegation, so the complaint is determined to be "valid". Description: Based on record review and interview it was determined that the center did not maintain compliance with their own policies and procedures.
Evidence:
1. The center's policy in the parent handbook states "If your child has an injury that may require more than our first aid skills allow or your child has been bumped on the head, we will make an immediate attempt to contact you.".
2. While in the care of staff #2 and #3, child #5 lost consciousness and fell to the ground, sustaining a concussion, and a bruise/knot on his forehead.
3. Staff #2 and #3 confirmed they did not follow the center's injury policy. When child #5 lost consciousness sustained a concussion and a bruise/knot on his forehead, while in care.
4. None of the center staff contacted the child's parent.

Plan of Correction: Staff have been retrained on how to properly care for a child with a head injury.

Complaint related: Yes
Description: Based on interviews it was determined the center did not ensure that all children under 10 years of age always shall be within actual sight and sound supervision of staff, except that staff need only be able to hear a child who is using the restroom.
Evidence:
1. On 9/21/23 child #5 was in the gym with staff #2 and staff #3 when he lost consciousness and fell to the floor, sustaining a concussion.
2. Staff #2 and #3 both reported that they did not see child #5 lose consciousness, as they were engaged with parents of students at the time.
a. Another student informed the staff that child #5 was crying. Staff then saw child #5 on the ground crying.
b. Staff #3 reported that child #5 was laying against the wall on the floor crying and he couldn't understand him when he was trying to tell him what happened.
c. Staff #2 and #3 could not explain what happened to child #5 prior to finding him on the ground, crying, breathing heavy, and not acting like himself.
d. The child reported "he was walking around, his head got fuzzy, he was asleep, and woke up on the ground".
e. Parent reported his pupils were dilated, and he had a bruise/knot on his forehead, he was taken to CHKD and diagnosed with a concussion.

Plan of Correction: Staff have been retrained on the policy of keeping students within sight and sound at all times.

Complaint related: Yes
Description: Based on record review and interview it was determined the center did not ensure that the written record of children's serious and minor injuries which entries are made the day of occurrence contained all of the required information.
Evidence:
1. On 9/21/23 child #5 was in the gym when he lost consciousness and fell to the floor, sustaining a concussion. The injury report was not completed as required.
a. The injury report dated 9/21/23 was not completed the day of the injury.
b. There was no second signature or treatment administered.
c. Staff confirmed the report was not complete and was not filled out on the day of the occurrence.

Plan of Correction: Staff have been retrained on how to properly document injuries and the importance of having staff sign the injury report.
