Comments:
An unannounced complaint investigation was initiated along with Licensing Inspector Keesha Minor on 9/7/23 in response to a complaint received in the licensing office regarding allegations of teacher qualifications, physical plant, care and protection of children and behavior guidance. Based on a review of documentation and interviews conducted, the allegation regarding teacher qualifications, physical plant, care and protection of children and behavior guidance were determined to be valid. Description: Based on a review of six staff files, the center did not obtain documentation of a tuberculosis (TB) screening for staff at the time of employment and prior to coming into contact with children and the documentation of TB screening/test was not within the last 30 calendar days of the date of employment .

Evidence:
1. The record for Staff #3, with a start date of 8/6/21, contained documentation of a tuberculosis screening dated 9/2/21
2. The record for Staff # 6, with a start date of 6/5/23, contained documentation of a tuberculosis screening dated 1/19/23.

Description: Repeat Violation

Based on observation, it was determined that not all areas of the center inside and outside were maintained in a clean, safe and operable condition.

Evidence: In the school age bathroom the toilet tank was split in half, approximately a quarter of the broken toilet tank cover had been removed and the larger portion was left in place. The remaining piece had sharp edges creating an impalement and scratch hazard.

Plan of Correction: Tank lid has been replaced

Description: Based on interviews, it was determined that the center failed to ensure the care, protection, and guidance of three, three-year-old children.

Evidence: On 1/26/23 at approximately 7:40 a.m. Staff #1 placed child #1, child #2, and child #3, three-years-old, on the wrong public school bus. It was not known until approximately five minutes later when a second bus arrived asking for child #1, child #2, and child #3.

Plan of Correction: Sign out sheet created for Buses with dates, times and bus number.

Description: Based on interviews, the center failed to ensure that each grouping of children had at least one staff member that met the qualifications of program leader or program director regularly present.

Evidence: At the time of inspection there were no staff members that met the qualifications of program leader in the Infant room since 8/4/2023, Toddler room since 8/11/2023, Preschool 2 room since 8/11/2023 and Pre-K2 room since 8/14/2023.

Description: Based on interviews, the center did not ensure behavioral guidance was constructive in nature, age and stage appropriate.

Evidence: An interview with the administration and staff revealed when Child #1 displayed challenging behaviors, Child #1 would be moved to other classrooms or taken to the office

Plan of Correction: New plan in Place. Admin stay in classroom to assist and guide.

Description: Based on documentation and interviews, it was determined that parents were not always informed when persistent behavior problems were identified and disciplinary steps taken in response.

Evidence: An interview with the administration confirmed behavior notices are given to parents when children display challenging behavior. Child #1, with a start date of 7/18/22, was identified as a child with challenging behaviors and in response to these behaviors the child was moved to other classrooms or the office. No documentation of behavior notices were in the child?s record.

Plan of Correction: New filing and documentation system in place.

Based on observation, the facility did not have a foot-operated disposal system for disposable diapers.

Evidence: In the two-year classroom, the foot operated disposal system was not working.
