Comments:
A monitoring inspection was conducted on October 26, 2023 from 10:50 am to 2:05 pm. There were 78 children present, ranging in ages from 2 to 8 years, with 15 staff supervising.

A total of eight child records and seven staff records were reviewed. The center's director and assistant director were available during the inspection to assist and answer questions.

During the inspection, the children and staff were observed participating in a variety of activities. Staff were also observed supervising the children during outside activities. Children were observed during rest time. Staff interactions with the children were positive.

The required postings were reviewed and found to be in compliance. The center is equipped with toys and supplies and items were available to the children. The center administers emergency medication only.

Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.

Please complete the plan of correction and date to be corrected for each violation cited on the violation notice and return it to me within 5 business days from today. Please specify how the deficient practice will be or has been corrected. Just writing the word corrected is not acceptable. Your plan of correction must contain: 1) steps to correct the noncompliance with the standard(s), 2) measures to prevent the noncompliance from occurring again; and 3) person(s) responsible for implementing each step and/or monitoring any preventative measures. Please do not use staff names; list staff by positions only.

Violations:
Standard #: 22.1-289.035-B-4
Description: Based on record review and interview, the center failed to obtain an out of State Sex Offender Registry, out of state criminal history name check and out of state Child Abuse and Neglect Search from any state in which the individual has resided in the preceding five year.

Evidence:
1. The record for Staff #3 (date of hire: 6/20/23) documented a sworn disclosure statement, indicating having resided outside of the state of Virginia within the preceding five years.
2.There was not an out of state sex offender registry, out of state criminal history name check, and out of state child abuse and neglect search documented in the record for Staff #3 for one of the two states documented on the sworn disclosure statement where Staff #3 lived within the preceding five years.
3. During an interview, with the center assistant director, it was acknowledged that Staff #3 lived in two other states within the preceding five years and the record did not document the required out of state checks for Staff #3.

Plan of Correction: Sex offender results completed during the inspection.

Assistant director will ensure employee gets criminal record check completed by 11/3/23.

Assistant director will ensure out state central registry check requested by 11/3/23.
