Comments:
An unannounced inspection was initiated on 10/23/23 with a local agency in regards to a self-report by the center of a forbidden action, rough handling of a child in care. The on-site inspection lasted from approximately 9:00am to 9:30am. Observed evidence of the incident was reviewed, and staff were interviewed. Off-site interviews were also conducted on 10/23/23. The inspection was continued on-site on 10/25/23 with a staff record review and a child record review. Additional observed evidence was reviewed off-site on 11/28/23. Violations were cited as a result of the inspection, and can be reviewed on the Violation Notice. Please complete the "Plan of Correction" and "Date to be Corrected" areas on the Violation Notice for each violation cited and return to me by close of business on 12/13/23. Plans of correction should include steps to correct the noncompliance with the standard, and measures to prevent the noncompliance from occurring again.

Violations:
Standard #: 8VAC20-780-400-B
Description: Based on observed evidence and interview, the center did not ensure that behavioral guidance was constructive in nature, age and stage appropriate, and was intended to redirect children to appropriate behavior. Evidence: According to observed evidence, between approximately 2:45 PM and 3:00 PM on 10/19/23, Child A, a four-year-old, began to run around the classroom holding their shoes in their hands. Staff #1 picked up the classroom?s tablet and appeared to take pictures of Child A with the tablet as the child ran around the classroom holding their shoes. Staff #1 did not speak to Child A to redirect the behavior, Staff #1 stood still and appeared to take pictures of the child?s behavior from across the room. When Child A noticed Staff #1 taking pictures of them, Child A then threw their shoes and Staff #1 began to run after the child as the child ran away from the staff member.

Plan of Correction: The staff member was immediately removed and an immediate retrain of all staff regarding positive behavior guidance and forbidden actions was completed and will be ongoing.

Standard #: 8VAC20-780-410-1
Description: Based on review of observed evidence and a cellphone picture, and interview, the center did not ensure that a forbidden action, rough handling of a child in care, did not occur. Evidence: According to observed evidence, between approximately 2:45pm and 3:00pm on 10/29/23, Staff #1 was observed to grab the left arm of Child B, a four-year-old, just above the elbow and then quickly walk the child to a table, roughly holding the child?s arm up in the air as they walked. Moments later, Child A, also four-years-old, was observed to begin running around the classroom with their shoes off. The child began to throw their shoes and Staff #1 approached the child, grabbed their right upper arm, and pulled the child halfway around the classroom to a chair as the child struggled to keep up. Staff #1 then roughly lifted Child A onto a chair. Staff #1 began to shake Child A by both upper arms and talked to Child A closely in the face as the child began to cry. Staff #1 then used their hand to roughly push Child A?s head up and backwards by under the chin. Staff #1 began putting Child A?s shoes on their feet as the child cried and attempted to stand up, then Child A appeared to yell at Staff #1 and the staff forcefully sat the child down again. Staff #1 finished putting on the child?s shoes as the child yelled and cried and then Staff #1 grabbed Child A by both upper arms and lifted the child into a standing position. Staff #1 sat down on the floor and pulled Child A down in front of them, facing them. Staff #1 continued talking close to the child?s face, and again pushed the child?s head up and backwards by under the chin, forcing the child to look at their face. After talking for less than a minute, Staff #1 then grabbed Child A by both upper arms again and roughly pushed the child back onto the chair, pushed the chair into the table, and then walked away. A bruise approximately the size of a thumbprint was later observed on the front of Child A?s right upper arm.

Plan of Correction: The staff member was immediately removed and an immediate retrain of all staff regarding positive behavior guidance and forbidden actions was completed and will be ongoing.
