Comments:
A complaint inspection was initiated on September 21, 2023 and October 20, 2023 . The complaint was in regards to staffing and supervision, physical plant, programs, administration and special care provision and emergencies. Staff interviews, classroom observations and documentation were reviewed. The portions of the complaint in regard to administration and staffing and supervision were deemed VALID.

Information gathered during the inspection determined non-compliance(s) with applicable standards or law and violations were documented on the violation notice issued to the program.

Violations:
Standard #: 8VAC20-780-40-E

Description: REPEAT

Based on interview and review, the center did not ensure that the center's activities were maintained in compliance with these standards, the center's own policies and procedures that are required by these standards, and the terms of the current license issued by the department.

Evidence:

1. The center?s Child Supervision Guidelines states: "Children must be supervised, in the direct line of sight and within ear shot of a staff member, at all times. All state mandated adult to child ratios must be followed at all times. "

2. Center policy also states: "Face-to-Name means staff must see the child's face and say the child's name when confirming all children are accounted for throughout the day. Face to names must be used to document staff to child ratios throughout the day: hourly, children arriving or leaving the classroom, transitioning children from one location to another (playground, fieldtrips, electives etc.), combining and or blending classrooms. Face to Name sheets is kept current at all times."

3. On September 6, 2023, Staff #3 confirmed that they heard a child #1 (4 years old) knocking on a bathroom door and yelling. Staff #4 looked over the bathroom stall from the 2-year-old classroom and went to the Pre-K classroom to open the bathroom door for child #1. During the time that child #1 was in bathroom, the child was not supervised as the center?s supervision policy requires and she could not be accounted for because the group she was supposed to be in had transitioned from the classroom to the outdoor play area. Staff #1 and Staff #2, who were responsible for her care, confirmed that child #1 was then brought out to them on the playground.

Plan of Correction: Staff have been retrained on Child Supervision, Face to Name procedures, and bathroom procedures. School management will monitor classrooms daily to ensure proper transitions and supervision requirements.

Based on observation, the licensee did not ensure areas and equipment of the center, inside and outside, shall be maintained in a clean, safe and operable condition.

Evidence: During inspection on September 14, 2023, the bathroom door in the Pre- K classroom was sticking, making it hard to open the door. On September 14, 2023, and September 21, 2023 Staff confirmed that the door sticks.

Plan of Correction: Door has been repaired. Safety Captain and classroom staff will monitor equipment and physical plant daily. Needed repairs will be reported to management immediately.

Based on interviews, documentation and video footage, the licensee did not ensure that when staff are supervising children, they shall always ensure their care, protection, and guidance.

Evidence:

On September 6, 2023, Staff #3 and Staff #4 were in the 2-year-old classroom. They heard Child #1 (4-years-old) yelling and knocking on the door. The bathroom door was stuck. Staff #4 left the 2-year-old classroom to open the door for Child #1. The length of time child #1 was in the bathroom was not able to be determined. Child #1 was supposed to be in the care of Staff #1 and Staff #2, who were outside with the other children. Staff #4 brought Child #1 outside with her class.

2. Staff confirmed the bathroom door in Pre-K classroom has been sticking for a few months.

Description: REPEAT

Based on interviews, the licensee did not ensure that children under 10 years of age are in sight and sound supervision of staff. Staff check on a child who has not returned from the restroom after five minutes. Depending on the location and layout of the restroom, staff may need to provide intermittent sight supervision of the children in the restroom area during this five-minute period to assure the safety of children and to provide assistance to children as needed.

On September 6, 2023, child #1 (4 years old) was left alone without sight and sound supervision for an undetermined amount of time. Staff #4 found Child #1 was found alone in the bathroom of the Pre-K classroom bathroom by the Staff #4. The group that the child was supposed to be in class was outside on the playground. Staff #1 and Staff #2, who were responsible for her care, were unaware that the child was not in their group on the playground.

Plan of Correction: Staff have been retrained on Child Supervison, Face to name procedures, and bathroom supervision procedures. School Management will monitor classrooms daily to ensure proper transitions and supervison requirements.
