Comments:
A self-report inspection was initiated on September 14, 2023, September 21, 2023 and October 20, 2023. The self-report was in regards to staffing and supervision. Video footage was reviewed, documentation and statements were reviewed, and staff were interviewed. The inspector reviewed compliance areas of staffing and supervision, physical plant, programs and administration.

Information gathered during the inspection determined non-compliance(s) with applicable standards or law and violations were documented on the violation notice issued to the program.

Violations:
Standard #: 8VAC20-780-40-E
Description: Based on interview and review, the center did not ensure that the center's activities were maintained in compliance with these standards, the center's own policies and procedures that are required by these standards, and the terms of the current license issued by the department.

Evidence:

1. The center?s Child Supervision Guidelines states: "Children must be supervised, in the direct line of sight and within ear shot of a staff member, at all times. All state mandated adult to child ratios must be followed at all times. "

2. Center policy also states: "Face-to-Name means staff must see the child's face and say the child's name when confirming all children are accounted for throughout the day. Face to names must be used to document staff to child ratios throughout the day: hourly, children arriving or leaving the classroom, transitioning children from one location to another (playground, fieldtrips, electives etc), combining and or blending classrooms. Face to Name sheets is kept current at all times."

3.The Face to Name transition sheet had child #1 checked off transitioning to the playground at 3:44pm. Video footage confirmed the children went outside at approximately 4:15pm and Staff #3 found Child #1 in the bathroom at 4:17pm. The incident report states on September 12, 2023, at 4:16pm, Staff #3 heard knocking on the bathroom door in the Pre-K classroom. Staff #3 open the bathroom door. Child #1 walks out of the bathroom. Staff #1 and Staff #2 confirmed that child #1 was brought out to the playground by Staff #3.

Plan of Correction: All staff have been retrained on face to name attendance procedures and transitions. School management will monitor transitions to ensure proper implementation.

Standard #: 8VAC20-780-270-A
Description: 8VAC20-780-270. Building maintenance

Based on observation, the licensee did not ensure areas and equipment of the center, inside and outside, shall be maintained in a clean, safe and operable condition.

Evidence: During inspection on September 14, 2023, it was observed that the bathroom door in the Pre- K classroom was sticking, making it hard to open the door. On September 14, 2023 and September 21, 2023 staff confirmed that the door sticks.

Plan of Correction: Door has been repaired. Safety Captain and classroom teachers will monitor equipment and physical plant daily. Any repairs needed will be communicated to school management immediatley.

Standard #: 8VAC20-780-340-A
Description: Based on interviews, documentation and video footage, the licensee did not ensure that when staff are supervising children, they shall always ensure their care, protection, and guidance.

Evidence:

On September 12, 2023, Staff #3 reported that child #1 (3-year-old) was left alone in the bathroom of the classroom. Staff #1 was cleaning the tables and Staff #2 was on the carpet with the children. Observed on video footage at approximately 4:00pm, child #1 goes into the bathroom and closes the door. Staff #1 and Staff #2 confirmed they were not aware that child #1 was in the bathroom.

2. Staff #1 and Staff #2 brought a group of children out to the playground. Staff #3 was walking through the classroom and heard knocking on the bathroom door. Staff #3 opened the bathroom door and child #1 came out of the bathroom. Child #1 was left in the bathroom of the classroom alone for approximately 2 minutes. Confirmed by video footage and staff interviews.

3. As confirmed by interviews, statements, documentation and video footage, Staff #3 found child #1 in the bathroom at approximately 4:17pm. During staff interviews confirmation was made that the bathroom door sticks.

4. The center?s incident report stated "Child #1 was left in the bathroom and that actions to be taken to prevent future incidents is to perform and follow proper face to name.

Plan of Correction: All staff have been retrained on supervision and face to name transition procedures. School management will monitor classroom transitions to ensure accuracy.

Standard #: 8VAC20-780-340-F
Description: Based on interviews and video footage, the licensee did not ensure that children under 10 years of age are in sight and sound supervision of staff. Staff check on a child who has not returned from the restroom after five minutes. Depending on the location and layout of the restroom, staff may need to provide intermittent sight supervision of the children in the restroom area during this five-minute period to assure the safety of children and to provide assistance to children as needed.

1. On September 12, 2023, child #1 (3 years old) was left alone without sight and sound supervision for approximately 2 minutes in the bathroom of the Pre-K classroom. Confirmed by the video footage that was reviewed on September 21, 2023.

2. After viewing video footage, it was determined that Child #1 went into the bathroom at approximately 4:00pm to approximately 4:17pm when he was found by another staff person. No staff checked on Child #1 while he was in the bathroom because staff were unaware that he was there. Staff #1 and Staff #2 went out to playground and left child #1 in the bathroom of the classroom. Staff #3 found child #1 at 4:17pm. Staff confirmed they did not know Child #1 was in the bathroom.

Plan of Correction: Staff have been retrained on bathroom supervision procedures. School management will continue to monitor classrooms to ensure proper supervision.
