A complaint was received by the licensing office on August 31, 2023 regarding behavior management, communication, and forbidden actions. A joint investigation with a local agency was initiated on September 5, 2023 and concluded on November 6, 2023. Interviews were conducted and records were reviewed. Based on the preponderance of evidence, the complaint regarding behavior management and communication is deemed valid. Violations cited can be found on the violation notice. Standard #: 8VAC20-780-40-E Complaint related: No Description: REPEAT VIOLATION
Based on record review and interview, the center failed to follow the center?s own policies and procedures.
Evidence:
1. The center has a policy that states ?one week?s notice will be provided for disenrollment, unless the inappropriate behavior jeopardizes the health and safety of other children or members of the Academy?s staff.?
2. On August 31, 2023, the center informed the family of Child #1 (age: 3 years) via email, that ?August 31st will be the final day of enrollment,? for Child #1 and their three siblings. The email indicated that the disenrollment was due to the center not feeling comfortable providing care to the children after a comment was made that the parent will be shutting the center down.
3. The center has a behavior management policy that states, ?our goal is to limit exclusionary measures and will only be considered when the health and safety of the child, other children, or staff is jeopardized.? The policy also states, ?exclusionary measures are not taken unless there is an agreement from all parties that it is in the best interest of the child. If exclusionary measures are taken the program will offer assistance to the family in accessing services and an alternative placement.?
4. Child #1 had four behavior reports about hitting classmates and teachers, and three behavior reports about running from teachers, written between March 27, 2023 and August 29, 2023. On August 29, 2023, the family of Child #1 was notified that the child would be suspended starting August 30, 2023 and could return to school on September 5, 2023. Witness #F confirmed that all parties had not come to an agreement that exclusionary measures were in the best interest of the child. The program did not offer assistance in accessing services and an alternative placement.
5. Witnesses B, C, D, and E all confirmed that there are multiple children who have exhibited behavior issues including hitting, kicking, spitting, throwing toys and running around.
6. Review of behavior reports indicated that Child #2 has had multiple behavior reports written due to choking classmates, wrapping their hands around classmates? necks, shoving, hitting, throwing toys, pulling hair, scratching and biting. Child #3 has had multiple behavior reports written due to hitting teachers, punching a teacher in the face, and kicking. Staff #1 confirmed that Child #2 and Child #3 have not been suspended.Plan of Correction: Not available online. Contact Inspector for more information.
Standard #: 8VAC20-780-350-Q Complaint related: No Description: Based on interview and record review, without a written assessment by the program director and program leader, the center assigned a child to a different age group that was not more appropriate for the child?s developmental level.
Evidence:
1. Staff #1 confirmed that Child #1 (age: 3 years) was moved to the four-year-old classroom after a parent made a complaint to the center that their child was picking up bad words from Child #1. Witnesses #A and #F confirmed that the child was not developmentally ready for the four-year-old classroom.
