Comments:
An unannounced monitoring inspection as well as a self-report received in the licensing office on July 31, 2023 was conducted on November 9, 2023. The inspector arrived at the facility at 12:00pm and departed at approximately 2:50pm. There were 58 children and 11 staff members present. A sample size of twelve records were reviewed which included six children?s records and six staff records. The Inspector observed staff and children?s interactions throughout the inspection. Children were observed during lunch, handwashing, free play, and nap time. Medications were observed as well as First Aid kits. No transportation is provided at this time by the center. Staff members were interviewed relating to the self report in addition to review of records. Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented. The violations are listed on the violation notice issued to the center and were reviewed with the site director at the exit interview.

Violations:
Standard #: 8VAC20-780-410-1
Description: Based on record review and interview, it was determined that the center did not ensure that the following actions or threats of physical punishment are forbidden.
Evidence:
1. Child #1 reported to his parent that Staff #2 ?Hit him on the butt.? The child reported to his mother that it ?hurt? and he was crying. The child reported to his parent that the incident occurred in the bathroom at the center.
2. Child #1?s parent was interviewed and confirmed that their child stated that he were hit on the butt by Staff #2.
3. Staff #3 was interviewed and confirmed that Staff #2 would take Child #1 in the bathroom area when upset or frustrated and Staff #2 would hear a hitting sound in the bathroom. Child #1 would immediately start crying after the hitting noise and Staff #2 would see the child come out of the bathroom crying.
4. Staff #3 stated that Staff #2 has been observed taking children into the bathroom when upset or frustrated and the children would come out of the bathroom crying.
5. Staff #2 was terminated after meeting with the administrative office on 07/31/2023, for failure to follow company policies, failure to follow state licensing requirements, and inappropriate discipline of a child.

Plan of Correction: The center responded with the following: Staff #2 was terminated on July 31, 2023. The center will ensure that the center comply with both company and State policies and standards.

Standard #: 8VAC20-780-440-G
Description: Based on observation and interview, it was determined that the center did not ensure that cribs shall be used for children under 12 months of age and for children over 12 months of age who are not developmentally ready to sleep on a cot or mat.
Evidence:
1. Two of the seven children in the infant room, ages 14 and 16 months, were sleeping in cribs.
2. Infant staff members confirmed that two children above the age of 1 2months old were sleeping in cribs.

Plan of Correction: The center responded with the following: Infant staff will transition the children above 12 months old to cots in the infant room. Parents will be informed of the standard and that children above the age of 12 months will now nap on a cot.

Standard #: 8VAC20-780-500-B
Description: Based on observation and interview, it was determined that the center did not ensure that disposable diapers shall be disposed either by a foot-operated or used in such a way that neither the staff member's hand nor the soiled diaper touches an exterior surface of the storage system during disposal.
Evidence:

1. In the infant room, the garbage next to the diaper changing station does not have a foot-operated diaper disposal. The garbage currently used requires that staff member?s hands touch the exterior surface of the storage system during disposal.
2. Infant staff confirmed that the garbage used to disposed diapers requires the staff member?s hands to touch the exterior surface of the storage system during disposal.

Plan of Correction: The center responded with the following: The center will purchase a new diaper disposal garbage that is foot operated.
